The audit is carried out for the following positions:
· Correspondence of the number of foreign employees in the organization to the approved proportion in certain types of economic activity.
· The existence of employment contracts concluded by employers with each of the foreign employees involved in their labor activities and the compliance of these contracts with the requirements of migration legislation.
· Correctness of the admission, transfer, suspension from work and dismissal of a foreign employee.
· Compliance with the procedure and deadlines for notifying State Authorities, as well as the correctness of filling in the forms of notifications on the admission/dismissal of foreign workers.
· Compliance of the organization and the foreign citizen with the rules for the implementation of migration registration (in accordance with the last migration registration).
· Compliance of the foreign citizen with the rules of migration registration at the place of stay in the Russian Federation in cases established by the legislation of the Russian Federation.
· The existence of the employer’s permits to attract and use foreign workers.
· The existence of the foreign worker’s work permits, patents, residence permits, as well as temporary residence permits.
Remarks:
· Verification of other items, as well as databases for violations of migration legislation, prohibitions on entry into the Russian Federation and the validity of documents is carried out by agreement of the parties for an additional fee.
· Verification is carried out remotely, for which the Customer must provide electronic copies of the documents requested by the Contractor. If necessary, the audit can be carried out on the territory of the Customer. The cost of the service is negotiated additionally.
· The number of audited foreign workers in one organization cannot exceed 2 people. The cost of auditing each subsequent foreign employee is calculated individually.
· Verification of documents is carried out for the last calendar year.
· Based on the results of the inspection, a lawyer's conclusion containing a description of violations, possible penalties, as well as recommendations for their correction is issued.
· The terms of the promotion apply to 2 foreign workers in one organization. Audit of other employees, as well as other items, can be carried out by additional agreement.
