The concept of a TRP (temporary residence permit), status advantages
There are several statuses of foreign citizens regulating their stay or residence in Russia:
- Temporarily staying - foreign citizens who have obtained a work permit, a patent and who are coming to Russia with such purposes as: tourism, business, work, humanitarian, educational.
- Temporary residents - foreign citizens who received a TRP (temporary residence permit);
- Permanent residents - foreign citizens who have obtained a residence permit.
In this article, we will only talk about foreign citizens temporarily residing in the Russian Federation.
Temporary Residence Permit (TRP) – is a confirmation of the right of a foreign citizen to reside in the Russian Federation until he obtains a residence permit, issued in the form of a mark in the passport.
The TRP is issued for a period of three years and allows a foreign citizen to work without issuing additional permits. Moreover, there are a few more advantages of this status for a foreign citizen:
- The visa is issued for the entire validity period of the RWP;
- There is no need to count the length of stay, and no need for migration registration;
- One hundred percent probability of receiving a residence permit, and, in the future, citizenship of the Russian Federation (in case of compliance with the migration legislation) without obtaining any quotas.
How to obtain a temporary residence permit (TRP)?
There are two ways of obtaining a TRP.
The first way - without taking into account the quota for issuing the TRP, approved by the Government of the Russian Federation. A foreign citizen may be issued a TRP in a simplified procedure, in the following cases:
- born in the territory of The Russian Socialist Federative Soviet Republic and formerly a citizen of the USSR or born in the territory of the Russian Federation;
- recognized incapacitated and having a capable son or daughter, who are citizens of the Russian Federation;
- having at least one disabled parent who is a citizen of the Russian Federation;
- married to a Russian citizen who has a residence in the Russian Federation;
- who made investments in the Russian Federation in the amount defined by the Government of the Russian Federation;
- received for military service, for the period of his military service;
- being a participant in the State Program for the Promotion of Voluntary Resettlement in the Russian Federation of compatriots living abroad and his family members moving together with him in Russia;
- having a child who is a citizen of the Russian Federation;
- having a son or daughter who has reached the age of eighteen years, who are citizens of the Russian Federation and recognized incapacitated or limited in capacity by the decision of the court that has entered into legal force;
- under the age of eighteen years, receiving a temporary residence permit together with the parent (adoptive parent, guardian, trustee) - a foreign citizen specified in subparagraphs 1 to 6.3 of this paragraph;
- under the age of eighteen years, receiving a temporary residence permit at the request of a parent (adoptive parent, guardian, trustee) - a citizen of the Russian Federation;
- having reached the age of eighteen years, recognized incapacitated or limited in capacity in accordance with the legislation of a foreign state, receiving a temporary residence permit together with the parent (adoptive parent, guardian, trustee) - a foreign citizen specified in subparagraphs 1 to 6.3 of this paragraph;
- having reached the age of eighteen years, recognized incapacitated or limited in capacity in accordance with the legislation of a foreign state, receiving a temporary residence permit together with the parent (adoptive parent, guardian, trustee) - a citizen of the Russian Federation.
The second way is within the limits of the quota for the TRP annually allocated by the Government of the Russian Federation. This method involves the issuance of the TRP in two stages. Submission of documents for obtaining a quota for a TRP, and if the decision is positive - submission of documents for registration of a TRP.
Quota for the temporary residence permit
By the order of the Government of the Russian Federation, a certain number of quotas for the issuance of permits for temporary residence in the Russian Federation with distribution among its subjects is approved annually.
In 2017, for example, 2000 quotas for registration of the TRP were allocated to Moscow, 8000 to the Moscow region, 1500 to St. Petersburg and 400 to the Leningrad region.
Applications from foreign citizens willing to receive a TRP on the basis of a quota are received, as a rule, in the beginning of February, during the first 5 working days of each month.

In order to submit documents for the quota, it is necessary to fill in the form, to have a passport, a migration card and a registration with you.
The period for the application approval is approximately 30 days, after that the Ministry of Internal Affairs gives the lists on the allocation of quota indicating the full name and citizenship of the lucky ones.
Those foreign citizens who received quotas are obliged to apply for a temporary residence permit within two months from the date of the quota allocation.

Where to receive a TRP
At the moment it is possible to submit documents for the TRP in Moscow only in the Multifunctional Migration Center (MMC) in Sakharovo, which is located in Novaya Moscow, near the village of Sakharovo (50 km from MKAD).
Working schedule:
- reception of documents for the TRP and residence permit - from 08.00 to 20.00 (without days off);
- medical examination - from 8:00 to 20:00;
- testing for knowledge of the Russian language, history and legislation of the Russian Federation - from 08.00 - 20.00.
- fingerprinting registration before reception of the TRP from 08.00 to 20.00 (daily, except Saturday and Sunday).
There is an opportunity to make a preliminary registration for the reception of the TRP documents. This can be done (not only by the applicant himself, but also by his representative) when providing a notarized power of attorney. From June 30, 2017, the registration is made a few days in advance. At the beginning of the year, the preliminary registration can be extended for several weeks.
How to get to the Multifunctional Migration Center in the village of Sakharovo?
It is possible to get to the Multifunctional Migration Center in the village of Sakharovo by bus, which runs from the metro station Lesoparkovaya. The schedule of buses: from 6:35 to 3:25 from the "metro station Lesoparkovaya" and from 4:00 to 0:55 (from Monday to Saturday) or to 0:49 (on Sundays) - from the "Multifunctional Migration Center" (Sakharov). The bus enters directly the territory of the Center. The bus costs 55 rubles one way.
- Taxi - from metro station Anino / Teply Stan / Boulevard Dmitry Donskoy also offer their services. For 200-300 rubles they will take you to the MMC (private, illegal taxi drivers).
- If the foreign citizen gets to the MMC in Sakharovo by his own transport, a small parking lot for a couple of hundred car places is organized in front of the entrance. The cost of this parking is 50 rubles per hour.
For those who came by their own transport, in order to enter the territory of the MMC, it is necessary to pass through a checkpoint with a metal detector and also show a passport of a foreign citizen. We draw your attention to the fact that sometimes Russian citizens can not be allowed to enter the territory of the Migration Center in Sakharovo. The exception is cases of accompanying foreign citizens to submit and receive documents with a power of attorney.
At the entrance to the hall, directly to the place where documents are filled in, the foreign citizen shows the passport and announces that he wants to submit the documents. Only after that he passes to the hall of documents reception. In the terminal he is given a coupon for submission of the documents (on the basis of a pre-entry coupon) and waits for his number on the electronic panel.
Below is a list of those, who can pass without a queue (already with the coupon):
- Disabled persons of the 1st group;
- participants of the Second World War;
- persons over 75 years of age.
According to the employees of the Migration Center, the center can process not more than 200-300 sets of documents a day. That’s why the waiting period for submitting documents has increased.
Documents for the TRP
Depending on the grounds (obtaining a TRP because of the marriage, your parents, quota, etc.), the package of documents for the TRP is slightly different. In any case, it is necessary to prepare the following documents:
- certificate confirming the level of fluency in Russian language, knowledge of the Russian history and the basics its legislation. If the applicant has a certificate or diploma obtained in the territory of the USSR or after 1991 in Russia, then it is not necessary to take the exam, it is sufficient to provide the original diploma.
- certificate confirming the absence of infectious diseases, as well as HIV infection;
- migration card + copy;
- migration registration + copy;
- application for the issuance of a TRP (2);
- receipt for payment of the state duty of 1600 rubles;
- photos;
- notarized translation of the passport;
- if the documents for the TRP are submitted "by reason of marriage" with the Russian citizen, a certificate of marriage, a Russian passport of the spouse (spouse) and a copy of it must be attached to the package of documents;
- if the documents for the TRP are submitted "by reason of birth" - it is also necessary to provide a birth certificate, etc.;
- applicants who stay in the Russian Federation on a visa basis must provide a certificate of absence of a criminal record.
Fingerprinting registration for a TRP
After the a decision on the TRP, a foreign citizen is invited to undergo a procedure for fingerprinting (dactyloscopy). You can go through the procedure in Hall E (the hall for issuing ready-made documents).
State fee for TRP

Medical certificates for TRP
For foreign citizens who arrive in Russia to obtain a TRP in Moscow, a medical examination is conducted in accordance with clause 2 of Appendix 2 to the order of the Ministry of Health of the Russian Federation of June 29, 2015 № 384n (in any medical organization or other organization engaged in medical activities, providing primary health care, regardless of the organizational and legal form, with a license to carry out medical activities that provide for the relevant work (services)).
The list of medical organizations that conduct examinations of foreign citizens and issue medical certificates for the TRP in the Moscow Region is provided in Appendix 16 in the Resolution of the Ministry of Health of the Moscow Region dated December 15, 2015 No. 1890 and includes 84 organizations.
Certificate of the Russian language knowledge
In accordance with the Federal Law of April 20, 2014 N 74 "On Amendments to the Federal Law" On the Legal Status of Foreign Citizens in the Russian Federation" from January 1, 2015 when obtaining a TRP, residence permit or Citizenship of the Russian Federation, foreign citizens are required to confirm the knowledge of the Russian language, knowledge of the Russian history and the basics of its legislation with the corresponding category, depending on what exactly the submission of documents is planned for.
There is no need to obtain a certificate of the knowledge of Russian language, history and the basics of the Russian legislation for foreign citizens who have received secondary or higher education, confirmed by a state document issued by an educational institution on the territory of a state that was a part of the USSR before September 1, 1991, or by an education document or the qualifications issued on the territory of the Russian Federation starting from September 1, 1991. When applying for a TRP, you must provide the original of this document.
In all other cases it is necessary to pass the test and get the corresponding certificate.
The cheapest place to pass the full examination for TRP and residence permit is the MMC in Sakharov, where its cost is 3500 rubles (on average, in other institutions like the PFUR, Pushkin Institute of Physics or Moscow State University, the testing cost is 5300 rubles).

It is possible to pass the complex testing and get a certificate of knowledge of the Russian language in the zone "T" Testing in accordance with the schedule:

You should have the following documents with you:

Term of issuance of the TRP
The term of issuance of the TRP for foreign citizens arriving in Russia in a visa-free regime is 60 days, and for citizens staying in Russia in a visa regime - 6 months from the date of acceptance of documents for TRP.

Obtaining a TRP
In case of taking a decision on a previously submitted document, foreign citizens should personally appear to receive the TRP and bring these documents:
- passport;
- a certificate of passing the fingerprinting registration (when receiving a TRP).
Every day the MMC issues not more than 200-250 coupons. The issuance begins at 09.00.
Validity of the TRP
Permission for temporary residence is issued for a period of three years with the possibility of submitting documents for the residence permits after six months of residing in the Russian Federation with a TRP.
TRP obligations
A foreign citizen with a TRP has the following obligations:
1. within 7 working days from the date the temporary residence permit was received:
- apply for registration to the structural subdivision of the Ministry of Internal Affairs of Russia at the location of the place of residence;
- in case of impossibility to register at the place of residence, to obtain a migration registration.
2. within two months from the day of the expiration of the following year from the date the temporary residence permit was received:
- send a notice of confirmation of residence in the Russian Federation with a certificate of income or other documents confirming the size and source of income for the following year from the date of obtaining the temporary residence permit to the territorial body of the federal executive body in the sphere of migration at the place of obtaining a temporary residence permit.
TRP. Confirmation of income and place of residence
In accordance with paragraph 9 of Art. 6 of Federal Law No. 115 of 25.07.2002 "On the Legal Status of Foreign Citizens in the Russian Federation", a foreign citizen temporarily residing in the Russian Federation within 2 months from the date of expiration of the following year from the date of obtaining the TRP is obliged to submit to the territorial body of the federal body of executive authorities in the field of migration at the place of obtaining the TRP a notification of confirmation of his/her residence in the Russian Federation with the attachment of income document, a copy of the tax declaration or other document confirming the size and source of income of this foreign citizen for the following year from the date the temporary residence permit was received.
In this connection, there are following questions:
- Can the bank deposit be regarded as a document confirming the size and source of income of a foreign citizen for the following year from the date of obtaining the TRP?
- Are there any requirements for the opening date of a bank deposit, should it be relevant for the entire year preceding the day of appeal?
Considering this issue, Confidence Group has sent a request to the Main Department of the Ministry of Internal Affairs of Russia on migration issues.
The answer of the Main Department of the Ministry of Internal Affairs of Russia on migration issues contained an indication that, in accordance with subparagraphs "L" clause 6 of the Rules for determining the average monthly income of a foreign citizen or stateless person and the average monthly per capita income of a family member of a foreign citizen or stateless person (approved by Decree of the Government of the Russian Federation No. 911 of February 9, 2007). The percentage of bank deposits is taken into consideration when calculating the average monthly income of a foreign citizen and a member of his family.
Thus, the availability of a legitimate source of income of a foreign citizen is indicated not by the deposit itself, but by its percentage.
The percentage of deposit can fall into the category "other documents" that confirm the size and source of income of a foreign citizen when applying for a confirmation of his residence with a temporary residence permit. The bank deposit with percentage should be relevant all the year preceding the day of appeal. The percentages should be active during the year and not be withdrawn one week before the notification.
TRP health insurance
Foreign citizens with a TRP must have a compulsory health insurance (CHI) policy. The policy is issued free of charge. It is necessary to write an application to any medical insurance organization that handles the issuing of compulsory health insurance policy, show a passport with a stamp of the TRP (preferably with a notarized translation), and a pension certificate (Insurance Number of Individual Ledger Account).
TRP Visa
The visa of a TRP (temporary resident) is issued upon receipt by a foreign citizen of a temporary residence permit in the Russian Federation.
The TRP visa is multiple and issued upon the application of a foreign citizen for the period of validity of the temporary residence permit at the place of permitted residence.
To apply for a TRP visa, a foreign citizen submits the following documents to the territorial body of the Ministry of Internal Affairs:
- a visa application form with a photograph;
- passport;
- a tear-off part of the notification of the arrival of a foreign citizen to the place of stay (in the absence of registration at the place where he/she resides);
- a migration card and its copy;
- a copy of the temporary residence permit.
On the basis of international agreements on mutual visa-free journeys, citizens of some countries who have a TRP in the Russia can enter the Russian Federation without a visa. The list includes citizens of Italy, Germany, Serbia, Poland, Turkey, Croatia, Bosnia and Herzegovina, Macedonia, Mongolia, Cuba and Montenegro. A visa is also not required for citizens of the CIS countries who only need to show a valid passport when crossing the border of the Russian Federation.
If at the time of making a decision to issue a TRP a foreign citizen is outside the Russian Federation, such foreign citizen is issued a TRP visa for a period of 4 months by a diplomatic representation or consular office of the Russian Federation abroad.
On the basis of this TRP visa, a foreign citizen must enter the territory of the Russian Federation to obtain a TRP and then apply to the territorial office of the Ministry of Internal Affairs for its extension for the term of the TRP validity.
A foreign citizen who could not enter the Russian Federation for the given period of 4 months by a TRP visa but his/her grounds for obtaining such visa were preserved, can receive a new TRP visa valid for 2 months from the delivery date upon written request.
Registration for TRP or the migration registration
A foreign citizen must register not later than on the 7th working day from the date of obtaining the TRP. The ground for registration of a foreign citizen temporarily residing in Russia at some place is his/her right to use this accommodation located on the territory of the Russian Federation, in the subject where the TRP was received. However, not every foreign citizen owns an accommodation, which does not cancel the corresponding obligation from him.
In case if a foreign citizen with a TRP does not have any documents confirming his/her right to use the accommodation, this foreign citizen will be obliged to register at this place in the manner prescribed by the Federal Law "On Migration Registration of Foreign Citizens and Stateless Persons in the Russian Federation" and the Rules for the Migration Registration of Foreign Citizens and Individuals without citizenship in the Russian Federation, approved by the resolution of the Government of the Russian Federation of January 15, 2007, No. 9.

Working with the TRP
A foreign citizen temporarily residing in Russia does not have the right to work with the TRP outside the subject of the Russian Federation on the territory of which he is allowed to have a temporary residence (clause 5, article 13, 115-Federal Law).
If a foreign citizen has a TRP, a work permit is not required (paragraph 1, clause 4, Article 13, 115-Federal Law).
Obligations of the employer when hiring an employee with a TRP
The employer hiring a foreign citizen with a TRP is obliged to notify the territorial body on migration issues of the Ministry of Internal Affairs about it within 3 working days from the date of conclusion / termination of the labor / civil law contract.

Responsibility of foreign citizen and employer
The Administrative Code of the Russian Federation establishes administrative liability for the following violations of the migration legislation:
1) if a foreign citizen or a stateless person works outside the subject of the Russian Federation on the territory of which a work permit, a patent or temporary residence permit has been issued to this foreign citizen:
- for foreign citizens from 5 to 7 thousand rubles.
2) if a foreign citizen, who has arrived in Russia in an order not requiring a visa, violates the period for applying for changes in the work permit/patent information:
- for citizens from 4 to 5 thousand rubles.
3) if a foreign citizen is attracted to work outside the subject of the Russian Federation on the territory of which this foreign citizen was issued a work permit, a patent or temporary residence permit:
- for citizens from 5 to 7 thousand rubles;
- for officials from 35 to 70 thousand rubles;
- for a legal entity from 400 thousand to 1 million rubles.
4) if an employer does not notify or violates the established procedure and/or form of notification of the territorial body of the federal executive body which exercises the federal state control (supervision) in the sphere of migration, on conclusion or termination of an employment contract with a foreign citizen within a period not exceeding three working days (from the date conclusion/termination of the contract):
- for officials from 35 to 70 thousand rubles;
- for a legal entity from 400 thousand to 1 million rubles.

Reasons for refusal to issue a TRP and its cancellation
In accordance with paragraph 1 of Art. 7 of the Federal Law No. 115 "On the Legal Status of Foreign Citizens in the Russian Federation" of 25.07.2002, a temporary residence permit for a foreign citizen is not issued, and a previously issued permit is cancelled if the foreign citizen:
- during the period of five years preceding the date of the application for the issuance of the TRP, he/she was subjected to administrative expulsion outside the Russian Federation;
- submitted counterfeit/fraudulent documents or reported false information about himself;
- repeatedly (two or more times) within one year was brought to administrative responsibility for committing an administrative offense related to violation of public order or residence regime, as well as an administrative offense related to illegal drug trafficking);
- after three years from the date of entry he/she has no residential premises in Russia on the grounds specified by the legislation of the Russian Federation;
- left Russia for a permanent residence in a foreign country;
- is outside the Russian Federation for more than six months;
- the temporary residence permit for a foreign citizen is not issued and the validity period of an earlier issued permit is annulled in case of the decision, taken in accordance with the established procedure that the residence of this foreign citizen in the Russian Federation is undesirable or that it is forbidden for this foreign citizen to enter the territory of the Russian Federation (paragraph 1 of Article 7).
How to obtain a TRP in another region (change of the TRP region)
A foreign citizen who has received a TRP in one region but who has grounds (the presence of a place of residence in the region, the presence of close relatives living in this region, etc.) to change the TRP region, can apply to the Department of the Ministry of Internal Affairs that issued the TRP.
It is also necessary to attach documents or their certified copies confirming the existence of grounds for changing the place of residence to the application. For example, a document confirming the right to use the accommodation in the proposed place of residence or a passport of a family member permanently residing in the specified subject of the Russian Federation.
The term for consideration of an application for a TRP in another region should not exceed two months from the date of its submission by a foreign citizen.
The employee who accepted the application for consideration sends this application and copies of documents confirming the existence of grounds for changing the place of residence to the territorial body of the Ministry of Internal Affairs at the intended place of residence within 7 working days.
Based on the results of the consideration, a motivated opinion on the consent or refusal to change the place of residence of a foreign citizen is sent to the territorial body of the Ministry of Internal Affairs, where a foreign citizen is allowed temporary residence.
The term for consideration of the application should not exceed 1 month from the date of submission of the application to the territorial body.
The decision to change the place of residence outside the subject of the Russian Federation is taken only on approval of the proposed place of residence by the territorial body of the Russian Ministry of Internal Affairs.
The territorial body of the Russian Ministry of Internal Affairs shall send a corresponding notification to the foreign citizen within three working days.
In the case of a positive decision, the foreign citizen is informed of the need to apply to the territorial body of the Ministry of Internal Affairs for removal from registration at the place of residence.
A foreign citizen is warned about the obligation to apply to the territorial body of the Ministry of Internal Affairs at a new place of residence for obtaining a migration registration on a receipt that is attached to the accounting case.
Accompanying family members
Only the underage children of a foreign citizen, who is applying for a TRP in the Russian Federation, are considered to be accompanying family members. Their documents for the registration of a TRP are submitted together with the main applicant.
A spouse does not have the right to apply for a TRP neither at the same time with the applicant, nor after he receives a TRP or residence permit.
