In continuation of our news about the discussion in the Public Chamber on the proposal of the Russian Ministry of Internal Affairs to oblige foreigners to be fingerprinted, photographed and examined by a doctor, we report on the planned changes.
On 23 March 2021, the State Duma adopted in its first reading draft law No. 1104310-7 to amend the Federal Law "On the legal status of foreign nationals in the Russian Federation" and the Federal Law "On State dactyloscopic registration in the Russian Federation" with regard to the regulation of the temporary stay of foreign nationals in the Russian Federation.
Under the draft law, foreign nationals arriving in the Russian Federation in a manner not requiring a visa would be obliged to undergo:
- mandatory state dactyloscopic registration;
- photographing;
- a medical examination confirming the absence of drug addiction, disease caused by the human immunodeficiency virus (HIV infection) and infectious diseases that pose a danger to others in medical organisations located in the Russian Federation.
However, this procedure will not apply to foreign nationals:
- who have received a patent, work permit, temporary residence permit or residence permit;
- have been recognised as refugees in the Russian Federation;
- who are legally incapable or restricted in their legal capacity;
- under the age of eighteen years;
- men who have reached the age of sixty-five years;
- women who have reached the age of sixty years
- heads of diplomatic missions and heads of consular offices of foreign states in the Russian Federation, members of diplomatic staff, officials of international (interstate, intergovernmental) organisations, as well as employees of their representative offices, and other categories of foreign citizens.
If foreign nationals evade compulsory state fingerprint registration, photographing or medical examination, the period of their temporary stay is shortened, and in some cases a decision on the undesirability of their stay (residence) in the Russian Federation or a decision on non-admission to the Russian Federation may be taken in respect of such citizens.
The second reading of the draft law is scheduled for April 2021 and we will keep you informed of any changes.
