A group of deputies from the Edinaya Rossiya (United Russia) parliamentary faction on 26.04.2021 submitted Bill No. 1159362-7 to the State Duma, which improves the decision-making procedure for banning foreign nationals and stateless persons from entering Russia, annulling residence permits and temporary residence permits, the RIA Novosti news agency reported.
When deciding on the prohibition of entry or the undesirability of a foreign national's stay (residence) in Russia, it is proposed to take into account, in particular:
- the degree of public danger of the offences committed by the foreign national;
- his personality, including good behaviour during his stay in the country;
- family circumstances.
According to the explanatory note to the draft law, often the migration authorities "do not take into account the public danger of the offence committed, the personality of the foreign national, including his bona fide behaviour during his residence in the RF, expressed in proper performance of obligations to pay taxes and fees in favour of the RF and other actions, as well as family circumstances - the presence in the RF of close relatives (minor children, spouse and other relatives) who depend on this citizen". This is where the changes will be aimed at.
The mechanism for taking into account the criteria for individualising a measure of state compulsion against a foreign national or stateless person would be established by the Russian government.
At the same time, the draft law will not cover a number of offences, among them: encroachment on public order or public security, drug trafficking, and labour activity without a permit or patent.
