It has become known that Department of the Ministry of Internal Affairs of Russia in the Moscow region (on Solyanka) requires using a form of guarantee letter, which, in addition to guarantees of material, medical and housing provision, provided for in the Administrative Regulations, also contains the following obligation:
• Provide a salary in an amount not less than the minimum wage established by Federal Law of 19.08.2000 № 82-FZ "On the minimum wage".
We remind you that in order to prepare and issue an invitation for a foreign citizen to enter Russia the inviting party shall submit an application to the migration department of the Ministry of Internal Affairs and attach all required documents including a letter of guarantee regarding undertaking obligations on material, medical and accommodation provision for the invited foreign citizen during his stay in the Russian Federation.
The procedure for submitting documents is determined by the Administrative Regulations of the Ministry of Internal Affairs of Russia on the provision of the public service for issuing invitations for entry into the Russian Federation to foreign citizens and stateless persons, approved by Order of the Ministry of Internal Affairs of Russia dated 29.09.2020 N 677. Administrative Regulations also establish samples of letters of guarantee for individuals and legal entities.
At the same time, in practice, territorial divisions of the Ministry of Internal Affairs of Russia place their own forms of letters of guarantee, as well as samples of their completion.
Please note that the requirement indicated at the beginning, was contained in the previous Administrative Regulations, approved by the Order of the Ministry of Internal Affairs of Russia from 21.09.2017 N 735, and was excluded in the current one, and is also absent in the forms posted on the official website of the division.
It follows that the requirements of the Department of the Ministry of Internal Affairs of Russia in Moscow Region to the letters of guarantee do not comply with the provisions of the Order of the Ministry of Internal Affairs of Russia from 29.09.2020 N 677.
