On September 27, 2018, in the third reading the State Duma has adopted Draft law No. 286369-7 “On Amendments to articles 2 and 23 of the Federal Law “On migration registration of foreign citizens and stateless persons in Russia”.
The draft law expands the list of acts included in the criminal composition of a fictitious registration of a foreign citizen, by registering in non-residential premises, to the addresses of organizations.
The draft law provides that fictitious registration at the place of stay - registration of a foreign citizen at the place of stay based on submission of deliberately false information or documents, or registration of a foreign citizen at a place of residence in a residential or other premises without their intention to actually live in this room or without the intention of the receiving party to provide them with this room for actual residence, or registration foreign citizen in the place of stay at organization in which he not works.
Article. 322.3 of the Criminal Code of Russia provides that a fictitious registration of a foreign citizen at the place of stay in a dwelling in Russia is punishable by a fine in amount of one hundred thousand to five hundred thousand rubles or in the amount of the salary or other income of the convicted person for a period of up to 3 years, or forced labor for up to 3 years with the deprivation of the right to occupy certain positions or engage in certain activities for up to 3 years or without it, or imprisonment for up to 3 years with deprivation of the right to engage in certain activities for up to 3 years or without that.
At the moment, the Criminal Code of Russia provides that fictitious registration of foreign citizens at the place of residence in residential premises in Russia is meant their registration at the place of stay (residence) in residential premises on the basis of deliberately unreliable (false) information or documents or their registration at place of stay in residential premises without the intention to stay (live) in these premises or without the intention of the receiving party to provide them with these premises for stay (residence).
After the approval of the draft law by the Federation Council and signing by the President of Russia and entry into force, the range of acts included in the criminal composition of the fictitious registration of foreign citizens will be extended by registering in non-residential premises, to the addresses of organizations.
