The State Duma of Russia at a meeting on July 6, 2022 adopted in the third reading a law according to which citizens of the DPR, LPR and Ukraine no longer need to hand over a passport and other documents to obtain a temporary asylum certificate.
The explanatory note states that this amendment removes from foreign citizens and stateless persons who have received temporary asylum in Russia the need to deposit identity documents (passport and others) to the territorial department of the federal executive authority in the field of internal affairs. This led to the fact that citizens who arrived to Russia in an urgent mass order in search of protection often refuse to apply for temporary asylum, since it is required to deposit identity documents. Since people hope to return home soon, they do not want to hand over their passport.
The existing unified database of authorized bodies makes it possible to control the border crossing by temporary refugees without depositing a passport.
The proposed amendment applies only to temporary shelter, as the most widespread phenomenon at the present time.
Although the original text of the draft law implied an exemption from the need to submit a passport to the Ministry of Internal Affairs for asylum seekers from all countries, the final text gives this right only to asylum seekers from the LDNR and Ukraine.
However, please note that in case of leaving Russia such a departure may be regarded as a departure to the place of residence, which, in accordance with paragraph 3 clause 5 article 12 of the Federal Law N 4528-1 dated February 19, 1993 "On Refugees" is the basis for the cancellation of temporary asylum.
