Let us recall that Decree 307 of 27.04.2023 regulates the legal status of the following categories of citizens:
1) citizens of Ukraine, the DPR and LPR who permanently resided in the territories of the DPR, LPR, Kherson and Zaporizhia regions as of 30.09.2022, or previously permanently resided in these territories and left from there for the Russian Federation, including through third countries, and declared their desire to retain their existing citizenship or remain stateless persons, did not take the oath of citizenship of the Russian Federation or refused to take it;
2) foreign citizens, but not citizens of Ukraine, the DPR and LPR, if they permanently resided in the territory of the DPR, LPR, Zaporizhia and Kherson regions as of 30.09.2022 on the basis of a residence permit issued by an authorized body of Ukraine, the DPR or LPR;
3) persons recognized on the basis of laws on the accession of new territories to the Russian Federation as temporarily residing in the territory of the Russian Federation (since September 30, 2022, such citizens have been recognized as foreign citizens and stateless persons temporarily residing in the territory of the DPR, LPR, Zaporizhzhya and Kherson regions - Article 31 of the relevant federal constitutional laws, as well as those who arrived there after September 30, 2022).
According to the provisions of the draft new decree, in view of the active involvement of foreign citizens in the work to restore the infrastructure of new regions, the period during which foreign citizens have the right to carry out labor activities in the territories of the DPR, LPR, Zaporizhzhya and Kherson regions without a patent and work permit is proposed to be extended until December 31, 2025 inclusive. The condition for such citizens to undergo fingerprinting and photographing remains in force.
The right of employers to hire foreign workers in these territories without permits is extended for the same period, provided that notifications are sent to the territorial bodies of the Ministry of Internal Affairs of the Russian Federation about the conclusion (termination) of labor and civil contracts with foreign citizens.
We also remind you that in the territories of the new subjects of the Russian Federation until January 1, 2026, a transition period is in effect, during which issues of their integration into the economic, financial, credit and legal systems of the Russian Federation, into the system of state authorities of the Russian Federation must be resolved.
Taking this into account, the draft decree stipulates that the provision of state services in the field of migration in the territories of the DPR, LPR, Zaporizhia and Kherson regions in full will be carried out from January 1, 2026.
