Previously, a foreign citizen could independently submit such a notification only in a limited number of cases - for example, when the host is unable to send such a notification for good reasons, or permanently resides outside of Russia, or if the foreign citizen owns residential premises. And earlier it was possible to do this in the form of an electronic message only if the foreign citizen was registered at the place of his stay in the residential premises owned by him or her (clause 3.1 of article 22 of the Federal Law of July 18, 2006 N 109-FZ " On Migration Registration of Foreign Citizens and Stateless Persons in Russia.
The consent of the owner of the residential premises to the actual residence (temporary stay) of a foreign citizen in the residential premises belonging to him is also confirmed using the Unified System of Identification and Authentication (Gosuslugi) portal. If the host party does not agree, the notice of arrival will be returned to the personal account of the foreign citizen.
According to the explanatory note, the draft law is intended to simplify the procedure for providing public services for the implementation of migration registration of foreign citizens in Russia.
The entry into force of the law according to the current version is expected 180 days after its official publication. Such a long period, according to the explanatory note, is due to the need to prepare and adopt the relevant by-laws. Changes will need to be made to Order of the Government of Russia dated January 15, 2007 No. 9 "On the procedure for carrying out migration registration of foreign citizens and stateless persons in Russia" and to the Order of the Ministry of Internal Affairs of Russia dated December 10, 2020 No. 856 "On approval of the Administrative Regulations of the Ministry Internal Affairs of Russia for the provision of public services for the implementation of migration registration of foreign citizens...."
