The draft law plans to amend paragraph 16 of Article 13.3 of the Law on the Legal Status of Foreign Citizens dated July 25, 2002 No. 115-FZ.
Currently, this paragraph provides that a foreign citizen does not have the right to carry out labor activities outside the constituent entity of the Russian Federation in whose territory he was issued a patent. The employer of a foreign citizen does not have the right to involve a foreign citizen in work activities under a patent outside the region where the foreigner was issued a patent, which entails difficulties if it is necessary to send foreign employees on business trips. Also, in case of moving to another subject of Russia, a foreign citizen is forced to re-issue a patent to work in a new region.
There is no text of the draft law yet, and its development will be associated with a number of difficulties - in particular, it is not yet clear how the amount of the advance payment when obtaining a patent will be determined. Currently, this payment is established in each region separately, reflecting the regional characteristics of the labor market established by the subjects of Russia.
