The Confidence Group company reports that recently Russian border control has started to prohibit entry to Russia based on the petitions of the Belarusian security authorities. The prohibition decision is given to a foreign citizen when crossing the Russian border. It contains information that according to the Art. 27 of the Federal Law "On the procedure for leaving the RF and entry into the RF" No. 114-FZ as of August 15, 1996 (on basis of state security or as a result of a foreign citizen's violation of the rules for crossing the border or other offenses) entry to Russia is prohibited for 3 or 5 years, the decision is made on the petition of the governmental agencies of the MIA of Belarus.
We found out that there is an international agreement between the Government of Russia and the Government of the Republic of Belarus on mutual recognition and enforcement of decisions to refuse entry to the territory of the state parties (ratified by Federal Law No. 299-FZ as of 03.11.2015).
The agreement indicates that state bodies of both Parties are recognizing the decisions of one of the parties on refusals to enter the state or issuing visa, reducing the period of foreign citizens stay in the country.
In accordance with this agreement, Russia recognizes bans to enter the territory of the country, if such were issued by the state bodies of Belarus.
It should be noted that as for the ban decision of authorities of Belarus that are of political ground, it’s almost unreal to appeal against them.
But chances for appellations in case the bans on entering Russia were issued based on violations of the rules of crossing the border and other norms of migration legislation made by a foreign citizen are much higher.
So, for example, Confidence Group previously reported on the specifics of entering of foreign citizens into Russia through certain border crossing points of Belarus. Violation of the indicated rules of crossing the border of the RF can also be reason on ban decisions.
