Foreign citizens and stateless persons participating in the activities of such organizations may also be prohibited from entering Russia - the draft law proposes to make a corresponding change to the law “On the procedure for leaving Russia and entering Russia” by removing from subparagraph 9 of Art. 26 word “non-governmental”.
As follows from the explanatory note to the draft law, the document “was developed in order to minimize the destructive influence on the social and political institutions of Russian society.”
The decision to recognize a legal entity as an “undesirable organization” is made by the Prosecutor General’s Office in agreement with the Ministry of Foreign Affairs, the decision itself is published on the website of the prosecutor’s office, and the organization is included in the list of the Ministry of Justice, published on the ministry’s website.
An organization may be considered undesirable on the territory of Russia if it:
- poses a threat to the foundations of the constitutional system of Russia, the country’s defense capability or state security;
- promotes or hinders the nomination of candidates, lists of candidates, the election of registered candidates, putting forward an initiative for a referendum and holding a referendum, achieving a certain result in elections, a referendum (including participation in other forms in election campaigns, referendum campaigns, with the exception of participation in election campaigns, campaigns referendum as foreign (international) observers);
- if in relation to this organization information has been received about its provision of intermediary services during transactions with funds and (or) other property belonging to a foreign or international non-governmental organization, the activities of which are recognized as undesirable on the territory of Russia, for the purpose of carrying out activities by such organization that pose a threat the fundamentals of the constitutional system of Russia, the defense capability or security of the state.
According to currently relevant court practice, participation in the activities of an undesirable organization can be recognized not only as cooperation with such an organization as its member or as an employee, but also as participation in events organized by such organizations, as well as the distribution of their materials.
