Beginning of September 1, 2017, amendments to the Federal Law "On citizenship of Russia" and the Federal Law "On legal status of foreign citizens in Russia" will come into force. The changes introduced new regulations concerning the admission to the Russian citizenship, simplification of admission into the Russia citizenship of Ukrainians as well as the new text of the oath of Russian citizenship admittance.
Federal Law as of July 29, 2017, N 243-FZ "On Amendments to the Federal Law "On citizenship of Russia" and Articles 8 and 14 of the Federal Law "On the Legal Status of Foreign Citizens in Russia" introduce the following text of the oath of persons acquiring Russian citizenship:
"I (surname, name, patronymic), voluntarily and knowingly accepting the citizenship of Russia, swear: to observe the Constitution and the legislation of Russia, the rights and freedoms of its citizens, to fulfill the duties of a citizen of Russia for the benefit of the state and society, to defend the freedom and independence of Russia to be faithful to Russia, to respect its culture, history and traditions".
A list of persons released from the text of the oath, as well as the principles of the order of taking the oath are established.
Also the procedure of accepting Ukrainian citizens into the citizenship of Russia is simplified. Required for admission to citizenship of Russia, the refusal of Ukrainian citizen from his Ukrainian citizenship is carried out by sending this citizen a request to renounce his Ukrainian citizenship to the Ukrainian authority. A document confirming the refusal of a citizen of Ukraine from his Ukrainian citizenship is a notary registered copy of the citizen's application to renounce his Ukrainian citizenship. Amendments to it have been made to the Federal Law "On Citizenship of Russia" and to the Federal Law "On the Legal Status of Foreign Citizens in Russia".
Also the reasons for cancellation of decisions on citizenship of Russia are introduced. The decision to acquire or terminate Russian citizenship is subject to cancellation in the event that it is determined that the decision was taken on the basis of false documents submitted by the applicant or knowingly false information, or in the event of the applicant's refusal to take the oath.
In Art. 14 of the Federal Law "On the Legal Status of Foreign Citizens in Russia", regulating the attitude of foreign citizens to the state or municipal service and to certain types of activity, clause 1.1 is introduced, which provides that the restrictions set forth in clause 1 of Article 14 of this Federal Law, do not apply to persons who are citizens of Russia and, at the same time, have citizenship of a foreign country that is not terminated for reasons beyond their control, provided that such persons voluntarily have issued a written waiver of their citizenship of a foreign country and handed over their main documents of a foreign state that prove their identity to the federal executive authority in the field of migration in the manner determined by the government of Russia. The list of reasons that entails the impossibility of renunciation of the citizenship of a foreign state is determined by the Government of Russia.
