On September 22, 2016, the Government Decree as of 12.09.2016 N 907 «On Amendments to Certain Acts of the Russian Government», changing the regulation of affixing the mark indicating the prohibition of the entry to certain categories of foreign citizens and persons without citizenship into Russia, came into force.
Previously, border control authorities and the Interior Ministry (its territorial body) had to affix the mark indicating the prohibition of the entry into Russia in the identity documents of foreign citizens and persons without citizenship, if such a decision was made in respect that a foreign citizen or a stateless person was issued with a decision on administrative expulsion from the RF, the deportation or transfer to the foreign state by readmission.
The new regulation added the following grounds for affixing the mark on the ban on entry into Russia:
- a foreign citizen or stateless person was repeatedly (two and more times) issued with a decision on administrative expulsion from the RF, the deportation or transfer to the foreign state by readmission (prohibition on entry within ten years from the date of the administrative expulsion from the RF, the deportation or transfer to the foreign state by readmission);
- the procedure on readmission was terminated to a foreign citizen or a stateless person during their previous stay in the RF in respect of the Art. 32.5 of the Federal Law "On the Legal Status of Foreign Citizens in the RF" (the ban on entry within three years from the date of departure from the RF);
- a foreign citizen or a stateless person has unexpunged or outstanding conviction for committing an intentional crime in Russia or abroad, recognized in accordance with the federal law;
- a foreign citizen or stateless person was issued with a decision on the undesirability of stay (residence) in the RF, including the presence of this citizen in the list of US citizens who are denied to entry Russia.
The following persons have the right to affix these marks:
- judges - in cases of administrative deportation from the RF of a foreign citizen who has violated the rules of stay in the RF, or the regime of the state border of the RF or the regime at checkpoints across the state border of the RF;
- officials of border control authorities - in cases of administrative expulsion from the RF of a foreign citizen who has violated the regime of the state border of the RF or the regime at checkpoints across the state border of the RF;
- officials of the Interior Ministry (its territorial agency) - in cases of the undesirability of stay (residence) in the RF of a foreign citizen or the deportation of a foreign citizen.
Mark is made by a special stamp. The form and the procedure for affixing the mark is approved by the Ministry of Internal Affairs of the RF and the Federal Security Service.
