On 27.01.2023, amendments to the Resolution of the Government of the Republic of Kazakhstan No. 148 dated January 21, 2012 "On Approval of the Rules of Entry and Stay of Immigrants in the Republic of Kazakhstan" come into force.
In accordance with the amended rules, citizens of the EAEU, including Russia, will be able to stay in the republic for not more than 90 calendar days from the date of crossing the state border of the Republic of Kazakhstan, with a total of 90 calendar days during each period of 180 calendar days. Previously, they could stay for 90 days continuously, there was no restriction on the number of days of stay in any period. To "reset" the permitted period of stay, it was possible to use the so-called "visa run" - to cross the border of the state. Now this method does not work, and it is impossible to stay in the country for more than 90 days within 180 days.
For citizens of states with which the Republic of Kazakhstan has ratified international agreements defining other terms of stay, the term is calculated in accordance with such an agreement, but in the Agreement between Kazakhstan and Russia on the procedure for the mutual stay of citizens of these states, there are no other terms.
If an excess of the permitted period of stay is established during entry, a decision is made to refuse entry based on paragraph 1 of article 48 of the Law of the Republic of Kazakhstan "On Population Migration".
These terms apply only to temporarily staying foreign citizens, foreign citizens who have a temporary residence permit in Kazakhstan can stay there during the terms of the temporary residence permit.
Also, if a citizen of Russia carries out labor activity on the territory of Kazakhstan, then in accordance with Art. 97 of the EAEU Agreement, he and his family members have the right to stay in Kazakhstan during the term of the labor or civil law contract concluded with the employer or customer of works (services).
According to Askar Aldongarov’s (head of the External Migration Department of the Ministry of Internal Affairs of Kazakhstan) speech, these innovations are "not a tightening, but bringing Kazakhstan's legislation in line with international standards," and are in no way connected with an increase in the migration flow of Russians to the republic.
