On October 24, 2016, the Constitutional Court of the RF stated that the ban on entry into Russia for foreign citizens, cured of tuberculosis, does not comply with the RF Constitution.
The citizen of the Republic of Korea, who was revealed with infiltrative pulmonary tuberculosis during his stay in Russia, appealed to the Constitutional Court. He had been under medical treatment abroad. According to the medical report, his health status was found to be satisfactory, allowing to live a normal life and do not pose a danger to others. After receiving the document, he appealed to the Tverskoy District Court of Moscow with the statement on the cancellation of the decision of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare of the undesirability of his stay in the RF in connection with the identification of the tuberculosis. The court rejected the claim. The appellate court upheld the decision, after that he appealed to the Constitutional Court.
The Constitutional Court noted that the cure of tuberculosis might become the grounds for the cancellation of the decision on undesirability of stay of foreign citizens in Russia.
The judges of the Constitutional Court also ordered lawmakers to make changes to the existing legal regulation, including the procedure to provide for the suspension of the decision on undesirability of stay.
