On January 9, 2017 on the basis of the decision of the Constitutional Court of Russia came into force the amendments to the Code of Administrative Offences on penalties for violations of foreign citizens in Moscow, St. Petersburg, Moscow and Leningrad regions.
These changes are amended the Russian Code of Administrative Offences on the basis of Decision of Russian Constitutional Court as of 17.02.2016 N 5-P "On the case of constitutionality checking of the provisions of paragraph 6 of Article 8 of the Federal Law" On the Legal Status of Foreign Citizens Russia ", parts 1 and 3 of Article 18.8 Code of administrative Offences and subparagraph 2 of the first paragraph of article 27 of the Federal law "On the procedure of exit from Russia and entry into Russia" in connection with the complaint of the citizen of the Republic of Moldova Mr. M. Turcan, "in which certain rules were unconstitutional.

The following acts of foreign citizens in the RF are provided in clause 1, 2 of the Article 18.8 of the Administrative Code
- violation of the rules of entry into Russia;
- violation of the rules of migration control, movement or choice of the place of stay or residence, transit through the territory of the RF;
- failure to confirm the residence in Russia;
- discrepancy of stated purpose of entry to Russia to activity or occupation, actually carried out during the period of stay (residence) in Russia.
If such violations were committed in Moscow or St. Petersburg, or Moscow or Leningrad region an administrative exclusion outside Russia was fined to a foreign citizen before. In accordance with new amendments an administrative exclusion outside Russia is not the obligatory fine. There are two variant of fines: an administrative fine from 5,000 RUR to 7,000 RUR or fines with administrative exclusion outside Russia.
