In September 2020, foreigners will be given another temporary reprieve so that they can legalize their legal status without falling under sanctions. Until the end of the year, they will not be able to deport them or make a decision about their undesirability of staying in the Russian Federation.
This decision was announced at a working meeting of human rights defenders with representatives of the Main Directorate for migration (GUVM) of the Ministry of internal Affairs of the Russian Federation.
Experts noted that the migration policy has moved towards humanization, but criticized the overly bureaucratic and clumsy work of local officials who misinterpret the laws and sabotage the instructions of the leadership.
After September 15, 2020, foreigners with valid documents will provide 185 days to ensure that they do not panic formalized the status to which entitled, said the head office for the licensing and visa work GUVM of the interior Ministry Oleg Molodiyevsky on the event of a new project "Forum of migrant organizations" "The Right in the Motherland", performed by the presidential grant.
The meeting at the Institute of CIS countries was attended by scientists, representatives of the Ministry of internal Affairs, representatives of the Rospotrebnadzor, the office of the President for ensuring the constitutional rights of citizens, and the Commissioner for human rights in Russia. More than half of the participants, from Vladivostok to Kaliningrad, joined the conference via the Internet. "Let's say that a person's residence permit ends on September 14, so while this period has not expired, he can come and extend the status for another 185 days," explained Oleg Molodiyevsky.
Recommendations have already been sent to the regions; visitors, according to the official, should not be expelled from the country during this time, as well as make decisions about their undesirability of staying.
Experts noted that the migration legislation of the Russian Federation, which has long been criticized for its inconsistency and repressive bias, is gradually being humanized. And in the context of the pandemic, the decision of the Ministry of internal Affairs gave the migration authorities a chance to legalize all those who are in the country without legal status. The problem is that regional officials are often not ready, are not able and do not want to build their work in a new way. According to the Chairman of the forum's Executive Committee, Lidia Grafova, today's absurd quirks prevent Russia from becoming attractive to visitors, especially compatriots.
Galina Ragozina, an expert of the forum of resettlement organizations, drew attention to the arbitrariness of regional officials. As an example, she recalled the order of the Russian Deputy interior Minister Alexander Gorov from March 19, which provides for migrants, in fact, a broad amnesty. But on the ground, Ragozina accented, " at best, people are denied, at worst, they can draw up a protocol and make a decision to expel them." GUVM representatives at the meeting called this approach incorrect, confirming that those who were in the "gray zone" before the pandemic should also be registered.
At the same time, according to Ragozina, the problem related to the registration of visitors from abroad, to whom the owners refuse to rent housing, and even more so to register in it, has worsened. Therefore, she suggests, it would be easier to make this procedure notifiable, and allow foreigners to be registered "including at the addresses of municipalities or migration authorities, until they decide on their place of residence."
As the head of the human rights organization "Civil assistance" Svetlana Gannushkina said, the ban on the expulsion of foreigners until September 15, established by the decree of the President of the Russian Federation, is not observed: "Public figures today are making Titanic efforts to get even citizens with Russian citizenship out of immigration removal center."
Migration authorities continue to go to the courts with applications for the deportation of foreigners, and judges automatically grant them, arguing that they are acting under the law, which is higher than any decree.
Among other things, public activists complained about the lack of clear guidelines on how exactly foreigners entering the country should be quarantined. Border guards, the Ministry of health of the Russian Federation, Rospotrebnadzor and the Ministry of internal Affairs OF the Russian Federation do not have the same requirements. But it is difficult for many migrants to find a place to register in such a short period of time: three days allotted for testing for coronavirus.
"These are almost insoluble conditions for foreigners. The tests themselves are extremely unstable, and it is more than unreasonable to link the legal status of a person in the country with them," said Alexandra Dokuchaeva, Deputy head of the Institute of CIS countries.
