On December 3, 2018, the Ministry of Internal Affairs of Russia published information on the migration amnesty for citizens of the Republic of Moldova staying on the territory of Russia in violation of the permitted period of stay. This information was published after the request of the President of the Republic of Moldova Igor Dodon, voiced by him during his official visit to Moscow in October 2018.
In accordance with the published information of the Ministry of Internal Affairs of Russia, citizens of the Republic of Moldova who are on the territory of Russia with violation of their tenure (Article 18.8. Of the Administrative Offenses Code of Russia “Violation by a foreign citizen or a stateless person of the rules of entry into Russia or of the residence (residence) regime in Russia"), in the period from January 1, 2019 to February 24, 2019, may travel outside Russia without administrative liability violation of the terms of stay and adoption of decisions regarding non-authorization of entry into Russia in respect of them (parts 4 and 8 of article 26 and parts 12, 13 and 14 of article 27 of the Federal Law as of August 15, 1996 114-FZ "On the procedure for leaving Russia and entry into Russia”).
For citizens of the Republic of Moldova who left the territory of Russia in the period from January 1, 2019 to February 24, 2019 and starting from February 25, 2019 they plan to return to Russia, work will be done (individually) to cancel or mitigate the actions already taken of them (in accordance with Parts 4 and 8 of Article 26 and Parts 12, 13 and 14 of Article 27 of the Federal Law as of 15.08.1996 114-ФЗ “On the procedure for leaving Russia and entering Russia”) of decisions on non-authorization of entry into Russia Federation.
However, during a personal conversation between Confidence Group employees and representatives of the Migration Department of the Ministry of Internal Affairs of Russia, we were not confirmed by this information published on the website of the Ministry of Internal Affairs about the cancellation or mitigation of the decisions on non-permitting entry to Russia and reported that this procedure would be individual character. In addition, no decisions, orders or other administrative legal acts on this action were taken.
In connection with the above, the Confidence Group warns that when deciding on the possibility of using the decision of the Ministry of Interior on the “migration amnesty” of the citizens of the Republic of Moldova, the agreements between Russia and the Republic of Moldova may not be implemented.
Confidence Group recommends that foreign citizens comply with the migration legislation of Russia, not to violate the length of stay, get up to migration registration in a timely manner and leave the territory of Russia at the end of the permitted period of stay.
