According to the official representative of the department, Irina Volk, the Russian
Ministry of Internal Affairs has prepared a draft law that excludes the possibility for foreign citizens and stateless persons to legalize their status in Russia through a fictitious marriage or fictitious recognition of paternity.
According to Volk, over the past 11 months, the Russian Ministry of Internal Affairs made about 400 decisions to annul permission documents previously issued to foreign citizens for living in Russia as a result of the invalidation of a marriage concluded by these persons with Russian citizens, based on a court decision.
Currently, the draft law is undergoing the procedure of interdepartmental coordination, its text is not available yet.
According to the current legislation, a foreign citizen or a stateless person has the right to apply for Russian citizenship in a simplified manner if he has been married to a Russian citizen for three years, and if he has common children, regardless of the period of marriage.
However, some experts consider this legislative initiative to be redundant, since there is still a sufficient legal basis to annul migration permits issued on the basis of fictitious marriages.
