On August 29, 2019, Order of the Ministry of Internal Affairs (MIA) of Russia as of June 4, 2019 No. 363 on approval of the application form of a foreign citizen to attract him as a highly qualified specialist (HQS) and the procedure for filling it out, as well as forms and procedures for notifying the MIA of Russia or its territorial body on work of foreign citizens in the territory of Russia was published.
Approved:
- application form of a foreign citizen to attract him as a highly qualified specialist;
- procedure for filling out a petition of a foreign citizen to attract him as a highly qualified specialist;
- form of notification on the employment of a foreign citizen of organizations providing employment services for foreigners in Russia;
- procedure for the submission of an organization providing services for the employment of foreigners in Russia, notification of the employment of a foreign citizen;
- form of notification of payment of wages to a highly qualified specialist;
- procedure for employer to provide notifications on salary payments to a highly qualified specialist;
- form of notification of conclusion of contract with a foreign student;
- form of notification of termination of contract with a foreign student;
- form of notification on granting leave to a foreign student;
- procedure for providing notifications of the conclusion, termination of the contract with a foreign student and notification of granting leave to a foreign student;
- form of notification of completion of studies by a foreign student;
- procedure for providing notification of completion of studies by a foreign student;
- form of notification of conclusion of a contract with a foreign citizen;
- form of notification of termination of a contract with a foreign citizen;
- the procedure for providing notice of the conclusion and termination of a contract with a foreign citizen.
Previous forms are invalidated.
The order of the Ministry of Internal Affairs of Russia dated January 10, 2018 No. 11 "On the forms and procedure for notifying the Ministry of Internal Affairs of Russia or its territorial body about the implementation by foreign citizens (stateless persons) of labor activity on the territory of Russia" was recognized as invalid.
It is possible to submit notifications to district authorities of the MIA of Russia. Information on receipt of notifications must be entered into the information system of MIA for provision of public services within 3 work days.
As a general rule, it is forbidden to use abbreviations. Notifications from two or more sheets now need to be flashed, numbered and make a certification entry in them.
In the notice of employment of a foreign citizen of organizations providing employment services for foreigners in Russia, a place has been added to indicate the passport data of the person confirming the accuracy of the information.
It is provided that in case of insufficient familiarity, an additional sheet to the notification is filled in the corresponding notification field. Such a sheet shall indicate the serial number and name of the field into which the missing information is entered, as well as the name of the foreign citizen in respect of whom a notification is provided. Forms of additional sheets are provided for by order of the MIA of Russia.
