This order was issued in order to implement the provisions of the Federal Law of July 14, 2022 N 357-FZ "On Amendments to the Federal Law "On the Legal Status of Foreign Citizens in Russia" and Certain Legislative Acts of Russia".
What is changing:
1) The procedure for conducting mandatory state fingerprint registration and photography has been supplemented with the rules for undergoing fingerprint registration and photography when changing the purpose of entry into Russia to work:
- foreigners who have the right to work in Russia without a work permit or a patent must undergo fingerprinting and photography in
within 30 calendar days from the date of conclusion of an employment contract or a civil law contract for the performance of work (rendering services) with the employer or customer of work (services), but no later than 90 calendar days from the date of entry into Russia
- foreign citizens who have the right to work in Russia on the basis of a patent, in the event of a change in the purpose of entry into Russia for work, are fingerprinted and photographed when applying for a patent.
2) A provision was added to the Order of the Ministry of Internal Affairs that the rules for passing fingerprinting apply to foreign citizens who entered Russia before 12/29/2021. Persons who arrived in Russia before this date both without the purpose of labor activity for a period of more than 90 calendar days, as well as for the purpose of carrying out labor activity, must complete the above within 180 calendar days from the date of entry into force of Law No. 357-FZ of 14.07.2022 , that is, until January 11, 2023.
3) Documents confirming the absence of HIV, passing a medical examination for the presence or absence of the fact that they use narcotic drugs or psychotropic substances and infectious diseases that pose a danger to others, when accepting foreign citizens for fingerprinting registration and photographing, it is no longer necessary to present. That is, if before it was impossible to undergo fingerprinting and photography without first undergoing a medical examination, now these procedures can be carried out independently and in any order.
4) Fingerprint registration and photography do not need to be done by persons recognized as refugees or granted temporary asylum in Russia, as well as stateless persons who have received a temporary identity card of a stateless person in Russia.
The exemption from fingerprinting and photography by employees of the diplomatic services, holders of diplomatic and service passports and administrative staff of representative offices of state authorities of foreign states, in accordance with the list formed by the Russian Ministry of Foreign Affairs on the basis of the principle of reciprocity, remains.
