The Order establishes requirements for the form, content and mandatory details of a written proposal for the entry into Russia of a highly qualified specialist.
This order applies to a foreign citizen or stateless person who has declared himself to be a highly qualified specialist, information about whom is posted on the official website of the Ministry of Internal Affairs of Russia. A written offer of entry to Russia by a highly qualified specialist is formalized:
- in a simple written form
- in Russian
- on the letterhead of a legal entity
- must contain information about the vacancy
- basic terms of the employment contract
- social guarantees
It should include the following information:
1) about the VCS:
- full name (in Russian and Latin alphabet according to the ID card)
- date of birth
- gender
- citizenship (if available)
- series and number of the identity document
2) about the inviting party:
- full name of the employer or customer of works/services
- location
- TIN, KPP
- OGRN
- information on registration in the country of incorporation (in case of branches or representative offices of foreign legal entities in Russia).
The Order also establishes the procedure for interaction between the Ministry of Internal Affairs of Russia and a diplomatic mission or consular office of Russia when issuing an ordinary business visa to a foreign citizen or a stateless person who has declared himself as a VCS.
The diplomatic mission or consular office of Russia:
- sends information to the IDC of the Ministry of Internal Affairs of Russia or the territorial body of the Ministry of Internal Affairs of Russia at the regional level at the location of the employer or customer of works (services) by electronic communication not later than 3 working days from the day of application of the VCS;
- makes a decision on issuance of an ordinary business visa to the CCS on the basis of information received from the IDC of the Ministry of Internal Affairs of Russia or a territorial body of the Ministry of Internal Affairs of Russia at the regional level.
The Central Center of the Ministry of Internal Affairs of Russia or the territorial body of the Ministry of Internal Affairs of Russia at the regional level:
- within 3 working days after the receipt of information about the CCS shall verify compliance with the requirements set forth in para. 5 of Article 13.2 of the Law on the Legal Status of Foreign Citizens in Russia 115-FZ;
- informs the relevant diplomatic mission or consular office of Russia about the decision taken.
The Order shall enter into force on December 31, 2023. With its entry into force, the Order of the Ministry of Internal Affairs of Russia dated 04.09.2017 N 700 shall cease to be in force.
