The Ministry of Internal Affairs clarified who, in the case of personal identification, does not need to undergo mandatory fingerprint registration

On November 30, 2022, the Order of the Ministry of Internal Affairs of Russia dated November 16, 2022 No. 865 "On Amendments to Annexes No. 1 and No. 2 to the Order of the Ministry of Internal Affairs of Russia dated June 19, 2018 No. 384" On Approval of the Procedure for Personal Identification was published on the official portal of legal information of a person by fingerprints (palms) of hands in real time and the List of categories of persons in respect of which the mandatory state fingerprint registration is not carried out if their identity is identified as a result of verification by fingerprints (palms) of hands in real time"

The order clarified the list of categories of persons in respect of which mandatory state fingerprint registration is not carried out if their identity is identified as a result of a fingerprint check, as well as the procedure for such identification.

The provisions of Federal Law No. 357-FZ of July 14, 2022 "On Amendments to the Federal Law "On the Legal Status of Foreign Citizens in Russia" and Certain Legislative Acts of Russia" have been implemented.
 
A clarification has been added that fingerprinting is not carried out in the following cases:

- upon presentation by a foreign citizen of a document confirming the passage of mandatory state fingerprint registration and photography
- in the absence of such a document - during the identification of a person, as a result of an operational check by CIADIS-MIA, the presence in CIADIS-MIA of fingerprint information obtained earlier when the person being checked passed the mandatory state fingerprint registration for the same category.

Also, clarifications have been added to the items in the list of those for whom mandatory fingerprint registration for personal identification is not carried out, related to the introduction on January 1, 2023 of such a type of TRP as TRP for the purpose of obtaining education - mandatory fingerprint registration in case of personal identification is not carried out in relation to persons who applied for the issuance of such TRPs.

The order enters into force 10 days after its official publication, that is, on December 11, 2022, with the exception of the paragraphs related to the adjustment of the wording regarding the TRP for the purpose of obtaining education - they enter into force together with the relevant provisions of the laws, i.e. January 01, 2023.
