If this law is adopted, the registration of a foreign citizen in a residential premises will be allowed only if the norm of the area per one person is observed in accordance with Art. 50 of the Housing Code of Russia.
According to clause 5 of this article, the norms are established by the local governments.
In particular, the local authorities currently set the following norms:
- in Moscow - 10 sq.m. for individual apartments and 15 sq.m. for communal apartments ( Article 9 of the Law of Moscow dated July 14, 2006 No. 29)
- in the Moscow region - from 7.5 sq.m. up to 15 sq.m. for individual and communal apartments depending on the area
- in St. Petersburg - 9 sq.m. for individual apartments and 15 sq.m. for communal apartments ( Article 3 of the Law of St. Petersburg - dated July 19, 2005 No. 407-65)
- in the Leningrad region - from 9 sq.m. up to 12 sq.m. for individual and communal apartments depending on the area
Special norms may be established by federal laws, decrees of the President, laws of the subjects of Russian Federation under social employment contracts. However, under a social tenancy agreement, residential premises are not provided to foreign citizens and stateless persons, unless otherwise provided by an international treaty of Russia (clause 5, article 49 of the LC of Russia).
According to the explanatory note to the draft law, the adoption of this law will make it possible to more accurately predict the migration situation, strengthen migration control over foreign citizens living in Russia and will eliminate cases of abuse of the right by homeowners.
