On April 30, 2021, the President of the Russian Federation signed Federal Law No 116-FZ of 30 April 2021 "On Amendments to Certain Legislative Acts of the Russian Federation" which establishes restrictions for holding state, municipal and other posts in connection with citizenship (nationality) of a foreign state or the right to permanent residence therein. The law enters into force on 1 July 2021.
Thus, it is prohibited to hold state and municipal posts, posts of state and municipal service, as well as other posts for persons who have:
- citizenship (nationality) of a foreign State;
- a residence permit of a foreign State;
- other document confirming the Russian citizen's right to permanent residence in a foreign state.
Also it is prohibited for members of the armed forces, the Federal Guard Service, the Federal Security Service, the Foreign Intelligence Service, the military prosecutor's office and military bodies of the Investigative Committee, ambassadors and envoys, heads and deputy heads of the Central Bank and the Audit Chamber, auditors of the Audit Chamber, governors, the Commissioner for the protection of business rights in Russia, the Ombudsman for Children's Rights in Russia, regional deputies and several other categories to hold foreign national passports or residence permits.
If state and municipal employees, officials and other persons referred to in the law have citizenship of a foreign state or residence permit on the day the law enters into force, they are obliged to report this within ten days of the entry into force of the law.
However, within six months of the entry into force of the law, these persons may continue to serve (work) in the positions they hold, provided they submit documents confirming their intention to terminate their foreign citizenship or their right to permanent residence in a foreign country.
If the confirming documents are not submitted, they will be removed from their positions and dismissed from the service (job).
However, only in an exceptional order determined by the President of the Russian Federation, a Russian citizen with the citizenship (nationality) of a foreign state, which has not been terminated for reasons beyond his control, may be admitted to the state or municipal service or continue to serve, if the position does not require the registration of access to state secrets.
