The draft of the Order of the Ministry of Internal Affairs of the Russian Federation on the approval of the procedure for the provision of medical documents by foreign citizens (hereinafter - The Order) has been posted on the Federal portal of regulatory legal acts of Russia. The draft of the Order has been issued due to the amendments in Federal Law 115-FZ which will implement the need of passing repeated medical examination for foreign citezens and which shall come into force on December 29, 2021 (changes provided for by clause 19 of article 5 of the Federal Law 115-FZ of Russia). We have already wrote about the procedure for passing a medical examination and forms of medical documents in our news previously.
The procedure for filing the results of repeated medical examination of foreign citizens to the Ministry of Internal Affairs (hereinafter - MIA) will apply for both foreign citizens who have arrived in Russia for more than 90 days, without the purpose of carrying out labor activities, and for labor migrants.
The Order due to the text which has been already published should come into force on December 29, 2021. However, the final version of the draft has not been published yet, and the final text may differ from ccurrently published vrsion.
We invite you to get acquainted with important information for foreign citizens, in accordance with the published draft of The Order:
- medical documents can be submitted to the territorial office of the MIA at the place of residence of a foreign citizen or in enterprise, or to an authorized organization (such enterprises / organizations have not been approved yet, however, the constituent territories of Russia in which they will operate have been already approved, you can read more about this in our news;
- medical documents shall be provided along with an identity document (art. 10 of the Federal Law 115-FZ);
- medical documents shall be filed within 30 calendar days from the date of expiry of previously issued medical documents;
- medical documents for minors are provided by a parent or guardian;
- medical documents can be filed at the place of stay of a foreign citizen, both in hardcopies - to the territorial body of the MIA (or an enterprise or an authorized organization), or electronically - through the "Gosuslugi" portal (if the foreign citizen has an enhanced qualified electronic signature, as well as if it is technically possible to receive documents in electronic form from the territorial body of the MIA);
- the confirmation certificate (Appendix No. 2 to the Procedure) which confirms acceptance of medical documents (in case of personal application) shall be provided to foreign citizen once the documents recieved by authoized person, or in case of electroic filing an electronic messagewith confirmation shall be sent (no later than the working day following the date of filing documents).
Please note that there is no similar procedure provided for foreign citizens who undergo a medical examination for the first time.
However the territorial bodies of the MIA are already facing with the problem on receiving, storage and processing medical documents, so issuing of such procedure in the nearest future is predictable.
