According to the general rule of the Federal Law, reference information is provided to citizens and legal entities only with the consent of those persons in respect of whom such information is requested.
According to the amendments, from January 01, 2023, the owner of the residential premises can receive information about the persons registered in the premises belonging to him, including foreign citizens registered at the place of residence or at the place of stay in the residential premises owned by him without the consent of said foreign citizens.
The extent of data provided will include information that allows identifying these persons - full name, place and date of birth, date of registration at the place of residence (place of stay), and in relation to foreign citizens - also information about citizenship, date and terms of registration at the place of residence and registration at the place of residence. The procedure for providing relevant information will be established by the Ministry of Internal Affairs of Russia.
In the explanatory note to the draft law, the authors of the initiative noted that the owner of the residential premises, when exercising the rights associated with this premises, including the transfer into possession and use, urgently needs official information on the number of persons registered in this residential premises, as well as information allowing to identify these persons. In addition, when inheriting residential premises, the new owner often does not have an objective picture of the persons registered in the residential premises who have the right to use it, and bears significant risks when performing legally significant actions in relation to their property.
