The Ministry of Interior Affairs prepared the draft order «On approval of the Administrative procedure on the provision of the state service on registration, issuance, renewal and restoration of visas to foreign citizens and stateless persons by the Ministry of Interior Affairs». Now, the draft of immigration services providing procedure is being at the public debate.
The document is based on the items of the same Administrative procedure approved by the Federal Migration Service order as of November 30, 2013 №430. In case the new procedure is adopted, the former procedure will become invalid.
The draft proposes to extend the powers of the Ministry of Interior Affairs.
Thus, the paragraph 44 of the draft Administrative procedure stipulates that the Ministry of Interior Affairs and the territorial bodies are not ought to explain the reasons for refusal of registration of certain documents.
At the same time, the draft provides an exhaustive list of such reasons for refusal to provide public services. For instance, the new procedure provides new grounds for refusal of a visa. For example, a foreign citizen will not get a visa, if a foreign citizen was subjected to administrative expulsion from Russia, deported or transferred by a foreign state to Russia or transferred to another state by Russia in accordance with the international treaty of the RF on readmission during the previous stay in Russia.
Furthermore, there is the possibility of refusing to provide state services after receiving documents from the applicant, if it is necessary to ensure the country's defense, public order, and protection of public health or if the foreign citizen has outstanding or unexpunged conviction for committing a serious, exceptionally serious or intentional crime in or outside of Russia.
