This order was issued in order to implement the provisions of the Federal Law of July 14, 2022 N 357-FZ "On Amendments to the Federal Law "On the Legal Status of Foreign Citizens in Russia" and Certain Legislative Acts of Russia".
1) Who is required to undergo a medical check-up?
· foreign citizens and stateless persons, including those who arrived in Russia before December 29, 2021:
· for purposes not related to the performance of labor activity, for a period exceeding 90 calendar days,
· for the purpose of labor activity
2) Where can foreign citizens undergo a medical check-up?
In a medical organization authorized to conduct a medical check-up, established by the highest executive authority of a constituent entity of Russia.
At the same time, we remind you that with such organizations in Moscow and the Moscow region there are a number of nuances that need to be taken into account, and which we wrote about in our publication.
3) Who does not need to undergo a medical check-up?
The list of such persons has not changed compared to the established order of the Ministry of Internal Affairs of Russia dated December 21, 2021 N 1080. The following foreign citizens and stateless persons may not undergo a medical check-up:
· stateless persons who received a temporary stateless person identity card
· citizens of the Republic of Belarus
· officials of international organizations who entered Russia in connection with the performance of official duties, employees of representative offices of international organizations in Russia or other organizations who, in accordance with international treaties of Russia, have been granted a status similar to that of international ones, as well as members of their families
· children under 6 years of age
· refugees and persons granted temporary asylum on Russia
· on the basis of the principle of reciprocity - heads of diplomatic missions and consular offices of foreign states in Russia, members of the diplomatic and administrative and technical staff of diplomatic missions or consular offices of foreign states in Russia; holders of diplomatic, service passports and foreign officials who entered Russia in connection with the performance of official duties; employees and members of the administrative and technical staff of the offices of the military attaché, trade missions and other representative offices of state authorities of foreign states; as well as family members of all the above persons.
4) Where should documents for passing a medical check-up be submitted?
· to the territorial body of the Ministry of Internal Affairs of Russia at the regional or district level at the place of residence of a foreign citizen
· to the Federal State Unitary Enterprise "Passport and Visa Service" of the Ministry of Internal Affairs of Russia also at the place of stay of a foreign citizen. Therefore, we draw your attention to the fact that when applying to this company, the requirement to provide evidence of migration registration at the location of this company is not ruled out, although this requirement is absent in the regulatory legal acts.
· to an organization authorized by the federal city of Moscow
· submission of medical documents to the enterprise is carried out in the territories of individual constituent entities of Russia, the list of which is established by the Ministry of Internal Affairs of Russia
At the same time, we draw your attention to the fact that in some constituent entities of the Russian Federation the authorities refuse to accept medical check-up documents issued in other regions, which, in our opinion, is unlawful, since a foreign citizen in the event of a change in the region of residence and migration registration in another region ends up in the situation that he must undergo a medical check-up again in order to submit these documents at his new place of residence and migration registration, which has no legal grounds.
5) What needs to be provided?
· medical documents confirming the passage of a medical check-up
· identity documents recognized by Russia as documents proving the identity of a foreign citizen and a stateless person
· if a foreign citizen has not reached the age of eighteen years or is recognized by the court as incapacitated (partially incapacitated) - also documents proving the identity and confirming the authority of the legal representative
6) In what form are documents submitted?
· in paper form when applying to the migration unit of the territorial body of the Ministry of Internal Affairs of Russia, or to an enterprise or an authorized organization
· in electronic form - through the Unified portal of state and municipal services (Gosuslugi)
7) What is checked?
· compliance of medical documents with the forms approved by the Ministry of Health
· the presence of the organization that conducted the medical check-up in the List of authorized organizations
· availability of identity documents and compliance of information in them with information in medical documents
· documents drawn up in foreign languages must be translated into Russian and notarized
8) Details of the procedure for receiving documents and transferring information, terms for consideration, transferring information and storing copies of documents
· if the documents are submitted in paper form, a copy is made of them, certified by the signature of an authorized employee, the originals are returned
· copies of paper documents are stored in the territorial body of the Ministry of Internal Affairs of Russia for one year from the date of their acceptance
· when documents are received in paper form, a certificate of their acceptance is issued, when submitted in electronic form, an electronic message is sent about their acceptance no later than the business day following the day the documents were submitted
An authorized official of the migration unit of the territorial body of the Ministry of Internal Affairs of Russia, who has accepted medical documents, enters information about their acceptance into the information system of the Ministry of Internal Affairs of Russia, intended for the provision of public services, within 3 working days from the date of their receipt
