Order of the Ministry of Internal Affairs of Russia No. 866 dated 16.11.2022 "On amendments to the Administrative regulations of the Ministry of Internal Affairs of Russia on the provision of State services for issuing temporary residence permits in Russia for foreign citizens and stateless persons, approved by Order No. 407 of the Ministry of Internal Affairs of Russia dated June 8, 2020" has been published.
The main changes are the following:
1. The documents provided when obtaining a temporary residence permit by various categories of foreign citizens were approved:
1) finalists or winners of the all-Russian contest "Russia – Land of Opportunity" – a document confirming that the person who applied is a finalist or winner of the contest "Russia – Land of Opportunity", issued by the relevant Autonomous Non-Profit Organization.
2) specialists in the field of information technology, who are employees and contractors of accredited IT organizations, as well as members of their family (spouses, parents, spouses of parents, children, including adopted ones, spouses of children, grandparents, grandchildren):
- an employment contract with the job description or a civil law contract for the performance of work (provision of services) concluded with an accredited IT company, confirming the assignment of functions that require to have professional knowledge and skills in the field of information technology to a foreign employee;
- an educational document and (or) on the qualification of an IT specialist in the field of information technology, issued in 1992 - 1995 by organizations engaged in educational activities in the territory of Russia, as well as issued by a military professional educational organization or a military educational organization of higher education, or an educational document of an IT specialist in the field of information technology, issued in the territory of a foreign state and recognized in Russia in accordance with an international agreement, or a certificate of recognition of foreign education and (or) foreign qualification of an IT specialist;
- for spouses and relatives of an IT specialist - documents confirming the marriage or degree of kinship with an IT specialist
3) family members of a foreign citizen who has invested in Russia and meets the criteria established by the Government of Russia – documents confirming the marriage or the degree of relationship with the foreign citizen who invested in Russia.
Some clarifications have been added: if, based on the results of the interdepartmental request, any of the criteria described above is not met – the IT organization does not have state accreditation in principle, if the foreign investor's compliance with the criteria established by the Government of Russia is not confirmed, the temporary residence permit is not issued.
2. It has been added that proof of Russian language proficiency is not required for citizens of Ukraine. In addition, the state fee for obtaining a temporary residence permit and for issuing a document to replace a lost or unusable one due to an emergency is not charged for citizens of Ukraine
3. A reference to the current order of the Ministry of Labor Affairs with a list of professions whose representatives have the right to receive a temporary residence permit on the basis of labor activity in this profession for more than 6 months has been added to the regulation.
4. Education in Russia under the program for training scientific and scientific-pedagogical personnel in postgraduate studies (postgraduate studies in a military college) was added among the grounds for obtaining a temporary residence permit for former citizens of the USSR, additional supporting documents were added – a diploma of completion of postgraduate studies (postgraduate studies in a military college), a certificate of completion of postgraduate studies (postgraduate studies in a military college) or a diploma of a candidate of sciences.
5. The procedure for submitting medical documents for applying for a temporary residence permit in diplomatic missions and consular offices of Russia outside Russia has been clarified, and a clarification has been added on restoring the deadlines missed for admissible excuses - when applying to a diplomatic mission or consular office of Russia in the state of residence, upon arrival in Russia, there is a right to submit these medical documents on paper or in the form of an electronic document within 30 days from the date of entry into Russia, or at a later date, in the presence of documented admissible excuses, – but not more than 30 calendar days from the date of elimination of admissible excuses.
The Order comes into force on 01.01.2023.
