Order of the Ministry of Internal Affairs of Russia No. 868 dated 16.11.2022 "On amendments to the Administrative regulations of the Ministry of Internal Affairs of Russia on the provision of State services for issuing residence permits for foreign citizens and stateless persons and replacing residence permits for foreign citizens and stateless persons in Russia, approved by Order of the Ministry of Internal Affairs of Russia No. 417 dated 11.06.2020" has been published.
The main changes are the following:
1. The application form for a residence permit has been changed, new grounds for obtaining a residence permit have been added to it.
2. New categories of citizens eligible to apply for a residence permit and the relevant grounds have been added:
- finalists and winners of the contest "Russia – Land of Opportunity "
- specialists in the field of information technology, who are employees and contractors of accredited IT organizations, as well as members of their family (spouses, parents, spouses of parents, children, including adopted, spouses of children, grandparents, grandchildren)
- foreign citizens who have invested in Russia and meet the criteria established by the Government of Russia, as well as members of their family (spouses, parents, spouses of parents, children, including adopted, spouses of children, grandparents, grandchildren)
- foreign citizens who are citizens of Kazakhstan, Moldova or Ukraine (in accordance with and in pursuance of the Federal Law 357-FZ dated 14.07.2022)
- foreign citizens moving to Russia for permanent residence in accordance with international agreements of Russia on the regulation of the resettlement process and the protection of the rights of immigrants
3. The documents which are provided when obtaining a residence permit by various categories of foreign citizens have been approved:
1) finalists or winners of the all-Russian contest "Russia – Land of Opportunity" should provide a document confirming that the person who applied is a finalist or winner of the contest "Russia – Land of Opportunity", which is issued by the relevant Autonomous Non-Profit Organization
2) specialists in the field of information technology, who are employees and contractors of accredited IT organizations, as well as members of their family (spouses, parents, children, including adopted ones, spouses of children, grandparents, grandchildren):
- an employment contract with the job description or a civil law contract for the performance of work (provision of services) concluded with an accredited IT company, confirming the assignment of functions that require to have professional knowledge and skills in the field of information technology to a foreign employee;
- an educational document and (or) the qualification of an IT specialist in the field of information technology, issued in 1992 - 1995 by organizations engaged in educational activities in the territory of Russia, as well as issued by a military professional educational organization or a military educational organization of higher education, or an educational document of an IT specialist in the field of information technology, issued in the territory of a foreign state and recognized in Russia in accordance with an international agreement, or a certificate of recognition of foreign education and (or) foreign qualification of an IT specialist;
- for spouses and relatives of an IT specialist - documents confirming the marriage or degree of kinship with an IT specialist
3) family members of a foreign citizen who has invested in Russia and meets the criteria established by the Government of Russia – documents confirming the marriage or degree of kinship with the foreign citizen who invested in Russia
4) citizens of Ukraine, Moldova, Kazakhstan - a document confirming that the foreign citizen belongs to the citizenship of these states
5) for immigrants based on international agreements of Russia (Latvia, Turkmenistan) - documents provided by the Agreements on the regulation of the resettlement process with these states (permit, certificate)
Some clarifications have been added: if, based on the results of the interdepartmental request, any of the criteria described above is not met – the IT organization does not have state accreditation in principle, if there is no qualification document issued on the basis of an independent assessment of qualifications in the field of information technology in the form of a professional exam, if the foreign investor's compliance with the criteria established by the Government of Russia is not confirmed, a residence permit is not issued.
4. The terms of consideration of applications for the issuance of a residence permit on new grounds have been established:
- for those who move to Russia on the basis of international agreements - 4 months;
- for the finalists of the contest "Russia – Land of Opportunity", IT specialists, investors - 3 months.
5. It is indicated that Multifunctional Public Services Centers do not participate in the provision of services for accepting of documents for residence permits and their issuance. The result of the state service can be obtained in the migration unit of the territorial bodies of the Ministry of Internal Affairs of Russia at the regional and district levels, a register entry is not provided for this purpose.
6. It has been added that proof of Russian language proficiency for citizens of Ukraine is not required. In addition, the state fee for obtaining a residence permit is not charged for citizens of Ukraine
The Order comes into force on 01.01.2023, the provisions relating to obtaining a residence permit by investors - from 11.01.2023.
