In accordance with the final version of the law, Russian citizens who also have Ukrainian citizenship will be able to renounce it by submitting a corresponding application to the authorized bodies of Russia. The procedure for submitting such an application, its form, the list of documents provided with it will be determined by the bodies of the Ministry of Internal Affairs of Russia.
After its submission, the applicants will be considered not having Ukrainian citizenship from the moment of its submission, and the presence of this citizenship will be considered a fact that has no legal significance in the legal field of Russia for the emergence and termination of rights and obligations, as well as bringing to responsibility.
An application for renunciation of Ukrainian citizenship in respect of children under the age of 14 is submitted by their legal representative.
From the moment of filing an application for renunciation of Ukrainian citizenship, it is prohibited to use documents confirming Ukrainian citizenship or contain an indication of it (with the exception of actions related to renunciation of Ukrainian citizenship), including the use of a Ukrainian passport to travel to other countries. If the bodies of the Ministry of Internal Affairs of Russia receive information about the violation of this prohibition, an audit will be carried out, and if this information is confirmed, the bodies of the Ministry of Internal Affairs will issue a conclusion. From the moment the conclusion is issued, an application for unwillingness to be a citizen of Ukraine is recognized as invalid, and it will be possible to re-submit it only after 10 years.
In practice, such a mechanism is designed to ensure the admission of such citizens to filling state, municipal and other positions, to ensure the exercise of the rights to employment in state and municipal bodies, training in educational organizations that provide admission of applicants to state secrets, as well as to resolve other issues in which citizenship other countries, including Ukraine, is a limiting factor.
This law comes into force 90 days after its official publication, i.e. June 17, 2023.
