Beginning of September 2017 the Confidence Group company began to face the situation when employers are refused to issue foreign labor hire permits and work permits for HQS on the following grounds:
- the absence in the database of information on notifications on the conclusion of a labor or civil law contract with a foreign citizen;
- the lack of information in the database about the notification on the salary payments for HQS.
When submitting documents for issuing foreign labor hire permits or work permits for HQS, and when extending the work permits of HQS, employees of the General Administration for Migration Issues of the Russian MIA check all the notifications submitted by the employer to the territorial divisions of the General Administration for Migration Issues of the Russian MIA for all foreign citizens who work in organization. All notifications submitted by the employer are checked since the moment of signing a labor or civil law contract with a foreign citizen, including notification of the conclusion of a labor or civil contract with a foreign citizen, filed by the employer with the tax inspection (in the event that the labor the contract was concluded until 2015).
Thus, Confidence Group recommends you to present copies of all notifications (about the conclusion, including those filed with the Federal Tax Service of Russia, about payment of wages for the entire period of employment of the foreign citizen from the employer) when submitting documents for the extension of the work permit HQS, that.
The employer who applied to the territorial body of the General Administration for Migration Issues of the Russian MIA for issuing foreign labor hire permit, work permit of HQS or extending work permit of HQS learns of any violations related to the failure of the above notifications only at the time of receipt of these permits by receiving a refusal to issue or renew them.
The Confidence Group Company recommends the following actions for avoid receiving a refusal and loss of time:
- to check submitted notifications to all foreign citizens who are engaged in labor activity from employer for the past year, including those dismissed;
- to take actions to enter information about notifications submitted to the database of General Administration for Migration Issues of the Russian MIA (if notified);
- in the future, perform the procedure for checking the availability of notifications in the database after a certain time after they are submitted.
Please note that the presence of the employer's notifications with the original stamp of the territorial body of the General Administration for Migration Issues of the Russian MIA about the receipt of the notification does not mean that the information on this notification is contained in the database the General Administration for Migration Issues of the Russian MIA. Especially it concerns notifications sent through Russian Post.
