On the official website of regulatory legal acts, the Order of the Ministry of Internal Affairs of the Russian Federation dated December 27, 2021 No. 1139 "On approval of the Procedure for compulsory state dactyloscopy and photographing of foreign citizens and stateless persons who has arrived in Russia for purposes not related to the implementation of labor activities for a period exceeding ninety calendar days, or in order to carry out labor activities ".
We invite you to get acquainted with the most important provisions stated in the order:
• fingerprinting and photographing of foreign citizens is carried out once, with the exception due to the following cases:
a) if document confirming the passage of fingerprinting has been presented and in respect of which there is no information about the previously passed fingerprint registration and photographing / in the absence of the technical ability to carry out personal identification in real time;
b) if personal data changes (name, date and place of birth, citizenship, gender);
c) in the event of a violation of the anatomical integrity of the skin (persistent cuts, burns and other defects), as well as in case of loss of limbs (fingers, hands, etc.);
d) in case of persistent change in appearance is detected (plastic surgery, removal of scars) or other external changes.
• fingerprint registration is carried out in the territorial Ministry of Internal Affairs, subordinate events and authorized organizations (we wrote more about this in our newsletter);
• if there is technical possibility and existing account on the "GosUslugi" portal, you can make an appointment online;
• the following documents will be checked before dactyloscopy and photographing:
a) identifying documents (in accordance with Article 10 of the Federal Law No. 115-FZ);
b) documents confirming the powers of the legal representative (if a child is registered from 6 to 18 years old / incapacitated / disabled);
c) medical documents and a certificate of absence of HIV infection.
• photography can be carried out in a headdress that does not hide the oval of the face, in glasses (in cases where a foreign citizen constantly wears them), in lenses that do not change the color of the eyes.
• on the day of the procedure of fingerprinting registration and photographing, a foreign citizen is issued a document confirming the completion of these procedures (except for those who receive a patent, a document can be issued to them upon application within 10 days).
• fingerprint registration and photographing are not subject to:
a) persons under 6 years of age;
b) persons who carry out official duties on the territory of the Russian Federation and are officials or employees of international organizations in accordance with international treaties with the Russian Federation.
c) citizens of the Republic of Belarus;
d) citizens of foreign states, in respect of whom, fingerprinting is not performed on the basis of the principle of reciprocity.
