Confidence Group informed repeatedly on the possible reasons for the cancellation of work permits, patents, and temporary residence permits of foreign citizens, nevertheless, we would like to draw your attention once again on such a reason as the absence of the HIV certificate.
According to the sub-paragraph 10 p. 9 of Art. 18 of the Federal Law "On the Legal Status of Foreign Citizens in Russia," the work permit is cancelled, if the foreign citizen has no certificate on the absence of the disease caused by the human immunodeficiency virus (HIV), or if the foreigner suffers by one of infectious diseases, which is a danger to others.
According to the sub-paragraph. 2 p. 22 of Art. 13.3 of this Federal Law, the issued patent is cancelled, if the foreign citizen has no certificate on the absence of the disease caused by the human immunodeficiency virus (HIV).
According to the sub-paragraph. 13 p. 1 of Art. 7 of this Federal Law, a temporary residence permit is cancelled, if the foreign citizen has no certificate on the absence of the disease caused by the human immunodeficiency virus (HIV), except the case if foreign citizens have family members (husband (wife), children (including adopted), parents (including adoptive) - Russian citizens or foreign citizens or stateless persons residing in Russia and there is no their violation of the Russian legislation on the prevention of HIV infection.
In accordance with the law, the validity of a certificate of absence of HIV infection is 3 months since the date of the medical examination. Thus, in accordance with the above law, a foreigner working on the territory of Russia must pass once a quarter a medical examination and update the relevant certificate.
The described reason for the cancellation of the work permit, patents, temporary residence permit is used MIA (previously FMS) are rare. Technically, it can be done only in case of physical verification of all the documents of a foreign citizen, however, such a reason for cancellation of the work permit, patent, temporary residence permit and there creates some risks for the employer and for the foreign employee.
Confidence Group recommends to regularly check the presence of a valid certificate of absence of disease caused by the human immunodeficiency virus (HIV), of foreign citizens engaged in labor activity in your organization and in case of absence - recommend to update it in order to avoid risks of cancellation of the work permit, patent, temporary residence permit.
