On June 13, 2018, the Government of Russia has submitted to the State Duma a draft law amplifying requirements for grounds for obtaining a temporary residence permit (TRP) by foreign citizens without taking into account the quota approved by the Government of Russia.
Cognation with citizens of Russia may become the basis for obtaining a TRP without taking into account the quota only if specified Russian citizens will have a place of residence strictly in the RF subject where TRP is planned to be received.
If this bill is adopted, such a requirement will apply to:
- incapacitated foreign citizens with a capable son / daughter, citizens of Russia;
- capable foreign citizens having incapacitated parent of a citizen of Russia;
- foreign citizens who are married to a citizen / citizen of Russia who have a residence in Russia;
- foreign citizens who have a child (under 18 years of age or over 18 years of age but recognized as legally incompetent) of a Russian citizen;
- foreign citizens (under 18 years of age or over 18 years of age, but recognized as legally incompetent) who receive TRP at the request of their parents / guardians, citizens of Russia.
At the same time, it is suggested not to impose restrictions related to ban on their own volition to change the place of their residence within or outside the RF subject on which territory a foreign citizen is issued a TRP in Russia, for temporarily residing foreign citizens:
- received the status of a participant (member of the participant's family) of the State program for promotion of voluntary resettlement in Russia of compatriots living abroad;
- residence of Russian citizens - relatives who moved to a new place, on the basis of relationship with whom the TRP was received.
