On January 5, 2018, the Resolution of the Government of Russia No. 1668 as of 27.12.2017 "On amendments to the regulation on the implementation of federal state control (supervision) in the sphere of migration" came into force.
In the course of planned checks of employers attracting foreign citizens, Russian Internal Ministry officers are obliged to use checklists that contain questions about mandatory requirements in the field of migration, compliance with which is conditioned by the state's security. The subject of the planned inspection will be limited to the list of questions included in the checklists. In order to apply a risk-based approach, the activities of legal entities and individual entrepreneurs are to be assigned to one of the risk categories on the basis of approved criteria.
Conducting scheduled checks in respect of legal entities and individual entrepreneurs, depending on the risk category assigned to them, is carried out with the following frequency, unless otherwise provided by federal laws:
- for an extremely high risk category - once a year;
- for a high risk category - once every 2 years;
- for the significant risk category - once every 3 years;
- for the moderate risk category - not more often than once in 5 years;
- for the low risk category - not more often than once in 10 years.
The territorial bodies of the Russian Internal Ministry for the subjects of the Russian Federation maintain lists of legal entities and entrepreneurs whose activities are assigned to the risk category.
