For the first time, the President of the Russian Federation signed an order to temporarily suspend the validity of documents for foreign citizens for the period from March 15 to June 15. More details in our news here.
On June 15, the President of the Russian Federation amended the Decree of April 18, 2020 N 274 "On temporary measures to resolve the legal status of foreign citizens and stateless persons in the Russian Federation in connection with the threat of the further spread of a new coronavirus infection (COVID-19)", increasing the period suspension of documents of foreign citizens until September 15. It is curious that the new Presidential Decree comes into force exactly from the date of publication, i.e. 23.09.2020, despite the fact that the documents themselves indicate the date "from September 16". In other words, it turns out that the provisions of Presidential Decree No. 274 were applied in relation to documents of foreign citizens that expired between March 15 and September 15, in accordance with the provisions of the previous (15.06.2020) edition of Presidential Decree 274, and in accordance with the new version of the Decree President No. 274, its provisions should apply only from 23.09.2020. This incident creates ambiguity in the procedure for applying the provisions of Presidential Decree No. 274 regarding those documents of foreign citizens that expired between 16.09.2020 and 22.03.2020.
However, we assume that upon expiration of the documents of foreign citizens in the period from March 15, 2020 to December 15, 2020, these documents will be considered valid for 245 days from the expiration date specified in such a document. In this case, we are talking about the expiration of the following documents:
- temporary stay;
- visas;
- migration cards;
- temporary or permanent residence of foreign citizens on the territory of the Russian Federation;
- registration at the place of stay or at the place of residence;
- temporary residence permit;
- residence permits;
- refugee certificates;
- certificates of consideration of the application for recognition as a refugee;
- certificates of temporary asylum;
- certificates of the participants of the State program.
Please note that the suspension of the running of the terms, according to Presidential Decree No. 274, has nothing to do with such documents as:
- work permits;
- patents;
- permission to attract foreign labor.
