Quota application procedure in 2017

Confidence Group would like to inform on the changes in the procedure of application of quota for foreign labor hire in 2018 as well as the quota correction in 2017 in Moscow.

Basing on the requests of the employers, the determination of the need of foreign labor hire will be held only with regard to foreign citizens coming to work in Russia from visa countries.

Schedule of reception of applications on increase of the need of foreign workers in 2017 and the need of foreign workers to fill vacancies or the execution of works (services) in 2018, arriving in Russia on the visa basis.

The procedure of application of quota for foreign labor hire in Moscow consists of several stages:

1	Submission of the application to the local Center for Employment	In full compliance with information indicated in quota/quota correction application.
2	Registration on the official web site of the Health Department of Moscow www.migrakvota.gov.ru	Registration is required in case of the primary quota application. Registration and work procedure is available here. If the organization has the branch office or autonomous subdivision in several regions of Russia, all of them shall be registered separately (confirmed by the head organization), for all of them the separate quota / quota correction application shall be done.
3	Generation of interactive quota application on the web site www.migrakvota.gov.ru	Quota Application can be made by copying previously generated application. Information on all citizens supposed to be hired next year shall be indicated. Quota correction In order to change the position, citizenship or the number of foreign workers indicated in the quota, first it is necessary to make the application for quota reduction, then form the application for quota correction. The procedure of the application for quota increase is the same as for the main quota. Common information The following positions shall not be indicated in the quota/quota correction applications: quota free (the list of quota free positions is available here); highly qualified specialists; foreign citizens to be hired within the Intergovernmental agreements on simplified work procedures.
4	Determination of the date and time of the documents submission to the Department of Labor and Social Security of Moscow	Within 5 days after quota/quota correction application is generated and sent for approval on the web site www.migrakvota.gov.ru, the authorized Department person informs the employer on the date and time of the visit to the Department of Labor and Social Security of Moscow. This information will be available in the “Status of applications” of menu bar. In the column “Type”, in addition to the comments on the application, the date and time of visit to the Department of Labor and Social Security of Moscow to provide applications for quota / quota correction, and other paper documents will be assigned. After the web site www.migrakvota.gov.ru is upgraded, the appointment of the visit in the Department will be done automatically by the employer.
5	Preparation of the documents	Required documents: 2 copies of quota application printed from the web site www.migrakvota.gov.ru, stamped by the organization. Power of attorney for a representative of organization, printed on organization’s letterhead, stamped by the organization. Copy of Tax Payer Number certificate (INN). Copy of the extract from legal entity’s public register (valid not more than 1 month). Guarantee letter, confirming the possibility of providing foreign workers with living premises for the working period. Guarantee letter, confirming the possibility of voluntary medical insurance in order to provide medical help to the foreign worker. Copy of the lease premises, confirming the actual address of the employer. All copies of documents should be presented stamped by the organization and signed by the authorized person along with originals. Representative offices and branches of foreign companies in Russia also need to provide: Copies of the certificate on registration and accreditation issued by the authorized authority. Copies of the permit to open a representative office and its accreditation, issued by the authorized authority.
6	Application to the Department of Labor and Social Security of Moscow	Documents are accepted by the Department of Labor and Social Security of Moscow located at: Str. Novaya Basmannaya 10, blg. 1. Office 102 Phone: 8- (495) -621-04-78

All copies of the documents should be certified by the signature and seal of certified organizations.

These copies are to be submitted together with the original documents.

The following applications are not be accepted for consideration:

sent by post or facsimile,
not certified by the signatures of the authorized officials and not certified by the seal of the organization (except for individual entrepreneurs);
made with violations of the recommendations to the order of filling the application of the employer, the employer's application to increase (decrease) the size of the need contained in Annex 2 to the Order of the Ministry of Labor and Social Protection of Russia as of 23.01.2014 N 27n.

Receipt and registration of applications are carried out in the order first in first out.

The schedule:

Monday - Thursday - from 9-00 to 16-00;

Friday - from 9-00 to 13-00;

Break - from 13-00 to 14-00.

Moscow region

Ministry of Social Development of Moscow region accepts requests from the employers hiring foreign workers from visa-countries.

Schedule of reception of applications on correction of the need of foreign workers in 2017 and the need of foreign workers in 2018, arriving in Russia on the visa basis.

5	Preparation of the documents	Required documents: 2 applications in printed form certified by the signature and seal of the organization; copy of the certificate of registration of the organization in the tax authority at the location in Russia and signed by the employer and stamped upon presentation of the original; copies of the notice on registration of the organization in the tax authority of the Moscow region and signed by the employer and stamped upon presentation of the original (for the employers, providing certificates of registration of the organization in the tax authority located not on the territory of the Moscow region); copy of the certificate of registration in the Unified State Register of Legal Entities and signed by the employer and stamped upon presentation of the original; copy of the extract from legal entity’s public register upon presentation of the original (valid not more than 1 month); copy of the lease agreement, confirming the actual address of the employer, certified by the seal and signature of the head, with the obligatory presentation of the original; copy of the lease of premises, certified by the signature and seal of the employer's organization or a letter of guarantee, confirming the possibility of providing a foreign worker with living premises for the duration of the employment; guarantee letter, confirming the possibility of voluntary medical insurance; a letter of justification for the need to attract foreign workers, containing information about the activity and the upcoming volume of the work, the reasons for the attraction of foreign workers, cooperation with the employment center of recruitment; power of attorney for a representative in the case of application (application) by the authorized person.

Please note that there are many other requirements for quota application processing, failure to meet all of them can cause the refusal in issuing quota/ quota correction for the employer.

Quota /quota corrections applications are not accepted and recorded in the case of:

sent by post or facsimile;
not certified by the signatures of the authorized officials and not certified by the seal of the organization;
incorrect / not completely filling of the documents;
not providing full package of the documents above.
