In accordance with the draft law, a Russian citizen holding a Ukrainian passport will be able to apply for renunciation of Ukrainian citizenship to the authorized bodies of Russia, and be considered not having such citizenship from the moment such an application is submitted. This can also be done through the State Services (Gosuslugi) portal.
The explanatory note states that at present, due to the current political situation, Russian citizens who also have Ukrainian citizenship (including citizens living in the new territories of Russia) are unable to renounce Ukrainian citizenship for reasons beyond their control. The adoption of this law will ensure the admission of such citizens to fill state, municipal and other positions, as well as resolve other issues in which the citizenship of other countries, including Ukraine, is a limiting factor.
The procedure for filing an application for renunciation of citizenship of Ukraine will be determined by the bodies of the Ministry of Internal Affairs. After its submission, the applicants will be considered not having Ukrainian citizenship from the moment of its submission, and the presence of this citizenship will be considered a fact that has no legal significance in the legal field of Russia for the emergence and termination of rights and obligations, as well as bringing to responsibility.
However, the draft law provides that if such citizens continue to exercise the rights and obligations arising from Ukrainian citizenship, including the use of a Ukrainian passport for any purpose, except for renunciation of Ukrainian citizenship, this will become known to the authorized bodies of Russia and this fact will be confirmed during an control inspection, the application for renunciation of Ukrainan citizenship will be considered invalid, and such a citizen - having the citizenship of Ukraine with all the ensuing consequences. It will be possible to re-submit such an application only after 10 years.
