The agreement was signed in Moscow on September 27, 2022, we wrote about its signing earlier.
The agreement provides that citizens of one of the countries have the right to acquire the citizenship of another country without renouncing their existing citizenship. In the part not regulated by the Agreement, the acquisition and termination of citizenship are carried out in accordance with the legislation of each party.
Citizens of both countries will be able to enjoy the rights to social security, education, medical care in accordance with the legislation of the country in whose territory they permanently reside, unless otherwise provided by the legislation of the country of permanent residence or international treaties. Also, these citizens have the right to have the protection and patronage of any of the countries of their choice when they are in the territories of third states.
In accordance with the Agreement, capable persons of full age, who were citizens of the Republic of Abkhazia as of August 26, 2008, and who have not lost it on the day of application, have the right to apply for admission to Russian citizenship in a simplified manner. The conditions, the procedure for filing an application, the list of documents to be submitted and the procedure for considering applications will be determined by the President of Russia.
The agreement also defines the procedure for determining the citizenship of a child under the age of 18, if he has the citizenship of both parties, in the event that one of the parties renounces the citizenship of one of the parents, as well as in other cases.
Persons who are citizens of both states do military service in the country of permanent residence at the time of conscription, and those who have completed military service in one of the states are exempted from the obligation to do it in another state.
In accordance with the agreement, the parties, upon request, provide each other with information about the acquisition of citizenship of a third state by citizens with dual citizenship of Russia and Abkhazia, as well as about their obtaining the right to permanent residence in a third state.
The agreement has a term of 5 years, with the condition of automatic renewal in the event that neither party expresses in advance in writing the intention to terminate it.
In addition to Abkhazia, Russia has concluded such agreements only with Tajikistan and Turkmenistan. However, at present, the agreement with Turkmenistan has ceased to be valid, but those who have received dual citizenship of Russia and Turkmenistan still retain their status. In the absence of such an agreement, or when the agreement does not provide otherwise (that is, for all other countries), a Russian citizen who also has a citizenship of another counrtry is considered by Russia only as a citizen of Russia ( clause 1, article 6 of the current Law on Russian Citizenship, clause 1, article 10 of the new Law on Russian Citizenship).
