On April 28, 2017, the amendments to the Federal Law "On the Legal Status of foreign citizens in the RF", introducing benefits for the registration of permanent residence permits for persons illegally deported from the Crimean ASSR will enter into force.
The changes were dedicated to the Article 8 of the Federal law "On the Legal Status of Foreign citizens in the RF", devoted to the permanent residence of foreign citizens in the RF.
Paragraphs 1 and 2 of this article refer to the general procedure for issuing the permanent residence permit. As part of the amendments to this federal law, new items 3.5 and 3.6 are added:
"3.5. The provisions of paragraphs 1 and 2 of this article are not applied when issuing the permanent residence permit:
- to a foreign citizen, or a relative in a direct ascending line, the adoptive parent or spouse was subjected to illegal deportation from the territory of the Crimean ASSR;
- to a relative in a direct descending line, adopted child or spouse of a foreign citizen specified in subparagraph 1 of this paragraph.
3.6. The application for the issue of a residence permit shall be submitted by a foreign citizen specified in paragraph 3.5 of this article with the submission of a certificate of rehabilitation issued by the internal affairs body, the prosecutor's office of the RF or the court. "
In Art. 9 of this Federal Law (grounds for refusal to grant or revoke a permanent residence permit), a new paragraph 8 is added:
"8. The permanent residence permit for a foreign citizen specified in paragraph 3.5 of Article 8 of this Federal Law shall not be issued in the cases provided by subparagraphs 1-7, 12, 13 of paragraph 1 and paragraph 2 of this article, and the permanent residence permit previously issued to the foreign citizen is annulled in cases, provided by subparagraphs 1-7, 10-13 of clause 1 and clause 2 of this article".
Therefore - a special regulation of the grounds for refusing to issue or canceling the permsnent residence permit for persons who have been subjected to illegal deportation from the territory of the Crimean ASSR and their relatives, is introduced.
