Namely, the Order authorizes the CVM to exercise the following powers:
- acceptance of documents for the issuance of work permits to HQS and extension of stay in Russia on this basis
- acceptance of documents for issuing an invitation to enter the HQS for the purpose of carrying out work activities
- making a decision to prohibit the employer or customer of work (services) from involving foreign citizens and stateless persons in work activities in Russia as HQS for 2 years (previously this decision was made by the head of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs, now the Central Internal Affairs Directorate)
The form of the application for issuing a permit to the employer (customer) to hire foreign labor is also changing - the Central Computer Office is also added as the body to which this application can be submitted. But corresponding changes have not yet been made to the Administrative Regulations for issuing permits to attract foreign workers.
The provisions of the Order on changing the person making the decision to prohibit an employer or customer of work (services) from involving foreign citizens and stateless persons in work activities in Russia as a HQS for 2 years will come into force on January 1, 2024, the remaining provisions will come into force through 10 days after publication of the Order, i.e. 20.11.2023.
Migration Centers (MCCs) were created in 2023 on the basis of Order of the Ministry of Internal Affairs No. 80 dated February 20, 2023 (they were actually established on June 02, 2023 according to an extract from the Unified State Register of Legal Entities).
There are also draft orders of the Ministry of Internal Affairs, according to which it is planned to transfer a number of other powers of the Ministry of Internal Affairs in the field of migration to the Central Migration Office, for example:
1) Draft order, according to which digital computers are given the right to accept:
- applications for a work permit, extension of the work permit, issuance of duplicate work permits, changes in the information contained in the work permit
- notifications about the payment of wages to HQS
- notifications about the conclusion and termination of employment and service contracts with foreigners
2) Draft order according to which the central computers of the Ministry of Internal Affairs will be able to accept documents confirming a medical examination.
In these draft orders, the listed powers remain with the bodies of the Ministry of Internal Affairs; the TsVM is added to the number of organizations performing these functions.
It is not yet clear how the provision of digital computer services will be organized; it is likely that separate acts will be issued, these are regulatory ones, as well as acts establishing the costs of services and sources of financing for digital computer activities. We expect that changes will also be made to the Administrative Regulations of the Ministry of Internal Affairs for the provision of relevant public services, and the forms will probably change.
We are closely monitoring the publication of orders and other acts of the Ministry of Internal Affairs regarding the transfer of powers of the Ministry of Internal Affairs to newly created structures and the procedure for their work, and we will inform you about all changes.
