On August 24, 2021, Federal Law No. 22-FZ “On Amendments to the Federal Law“ On the Legal Status of Foreign Citizens in Russia ”and certain legislative acts of Russia regarding the regulation of the legal status of stateless persons” came into force.
Under this law, stateless persons will be able to obtain a temporary identity document for 10 years. It is issued in the absence of documents proving the identity of a stateless person and recognized by Russia in this capacity, and in the absence of a state to which a stateless person can leave Russia if he has a residence permit or other document confirming the right to a temporary or permanent residence on the territory of a foreign state, or in connection with the execution of a decision made against him on administrative expulsion from Russia, on deportation or readmission.
Previously, the legislation of Russia provided for the identification of a stateless person, however, an identity document was not provided after that. The circle of persons who can apply for such a certificate is limited and includes:
- those released from places of imprisonment who have an outstanding criminal record, as well as in respect of whom decisions have been made on the undesirability of staying in Russia, but their deportation is impossible due to their lack of citizenship of a foreign state;
- those who were citizens of the USSR on September 5, 1991, who arrived in Russia to live after November 1, 2002, but did not acquire Russian citizenship and do not have any other citizenship and their children;
- persons in respect of whom a decision has been made on the undesirability of stay (residence) in Russia, administrative expulsion or deportation, but there is no state ready to accept them.
To obtain this document, a stateless person must apply to the territorial body of the Ministry of Internal Affairs of Russia with an application in person or through a parent / guardian. The term for consideration and issuance of a temporary document is 10 working days.
