At the moment, unverified information is being received that in connection with the cancellation of scheduled inspections (which we wrote about here), the Ministry of Internal Affairs of Russia is discussing the possibility of conducting massive unscheduled inspections in order to control the activities of employers (companies and individual entrepreneurs) that attract foreign labor, including to identify foreign employees who do not have a valid certificate of absence of HIV infection.
We remind you about the changes to the Federal Law of July 25, 2002 N 115-FZ "On the legal status of foreign citizens in the Russian Federation" in terms of medical examination for foreign citizens who arrived in the Russian Federation for work purposes (which we wrote about in this news), according to they will now need certificates of absence of HIV infection as well.
Confidence Group company has repeatedly informed about the possibility of canceling work permits, patents, temporary residence permits for foreign citizens if a foreign citizen does not have a certificate of absence of HIV infection (more on this here). The validity of such a certificate is only 3 months.
On September 9, 2021, the possibility of canceling permits for foreign citizens on the above basis was discussed with the Deputy Head of the Department for External Labor Migration of the Main Directorate of Internal Affairs of the Ministry of Internal Affairs of Russia Pavel Olegovich Dutov during a webinar on the topic "Foreign highly qualified specialists (HQS)" organized by the Commission on Labor Migration Council of the Chamber of Commerce and Industry of Russia on Foreign Economic Activity.
Taking this information into account, we strongly recommend that you check on a regular basis that foreign citizens working in your organization have a valid certificate of the absence of a disease caused by the human immunodeficiency virus (HIV infection), and, if it does not exist, update it in order to avoid risks of cancellation of a work permit, patent, temporary residence permit.
