As we wrote earlier, the service " Notifications on labor migrants " was launched on the website of the State Services. The following notifications can now be submitted online:
· on the conclusion of an employment contract with foreign citizens;
· on termination of an employment contract with foreign citizens;
· on obligations to pay salaries to foreign citizens - HQS.
To submit such notifications, the employer must fill out a form on the website of the State Services. It is necessary to send a notice of admission or dismissal within three working days, and about the obligation to pay salaries - quarterly. The service is provided free of charge.
Despite the fact that the State Services are actively notifying about the new option, Confidence Group sees great risks in submission of notifications in this way. Below we present the following, not correctly working, options:
· You can only sign the notification with an enhanced qualified electronic signature, which is an electronic analogue of a handwritten signature. It can be recorded on a flash drive, tokens or other information carriers. Accredited certification centers issue an electronic signature - for this you need to go there with a set of documents. You will need an application, passport, TIN, SNILS. Please note that the State Services do not accept all types of electronic digital signatures.
· It is impossible to indicate the floor and/or office in the address of the enterprise. There is a limit with indicating the house number only, which is a discrepancy between the data and the Unified State Register of Legal Entities.
· You will not be able to submit a notification if the foreign citizen had an extension of the work permit (refers to the HQS). When entering information about the validity of the work permit and the data from the back of the plastic card, the system fails, and it is not possible to fill out the notification.
· The form is intended to indicate only one region of labor activity, and if, for example, the work permit is covering several regions, it will not be possible to enter such information and send a notification to other subjects of the Russian Federation.
· When filling out notifications, it is possible to make a technical error, which may be associated with the human factor.
· It is impossible to guarantee that information about the submitted notification will get into the database of the Ministry of Internal Affairs and it is impossible to verify this information.
· When choosing the name of the state body to send a notification it is not always possible to select it correctly. We would like to draw your attention to the fact that this applies to the submission of notifications to territorial bodies.
· An electronic message about receiving the notification in the personal account will act as an approval of the submission of notifications. This message may appear later than the deadline prescribed by law.
· At the moment it is not clear whether the electronic message confirms that the notification was filled-in correctly and there is a possibility that you will get to know about the presence of errors in the notification at the moment of bringing to administrative responsibility.
Confidence Group recommends, to submit notifications personally, as we did before, so that when they are received, the inspector checks for the presence or absence of errors, to be sure that the notifications are submitted correctly and in a timely manner.
