Communications on the official websites of the Russian Ministry of Justice and the Federal Agency for Tourism provide information on the procedure for requesting the entry into the territory of the Russian Federation of foreign nationals - highly qualified specialists carrying out activities in the field of law or tourism, respectively.
We remind you that based on the Decree of the Government of the Russian Federation of 16 March 2020 № 635-r the federal executive authorities, in whose competence the organization – employer or customer of works (services) is, consider applications and send to the Federal Security Service of Russia and the Ministry of Internal Affairs of Russia lists of highly qualified specialists as well as family members of the indicated persons (hereinafter - HQS) entering the Russian Federation.
As follows from the communications:
- The Russian Ministry of Justice makes decisions if the organisation is under the jurisdiction of the Russian Ministry of Justice or carries out activities in the field of law;
- The Federal Agency for Tourism - in relation to organisations carrying out tour operator, hotel activities.
The Ministry of Justice points out that there is no special time limit for considering applications for assistance in forming HQS lists and notifying the Government of the decision taken.
In view of the above, in order to complete all internal procedures in a timely manner, the mentioned public authorities are requested to send the above documents and information with the actual dates of the planned entry of the HQS in advance.
Rosturizm recommends that applications should be sent at least one month before the arrival of a foreign national – HQS to the territory of the Russian Federation.
Recommended application forms are available on the official websites of the Russian Ministry of Justice and Rosturizm.
It is important to note that in the application for the Ministry of Justice, the code of OKVED (Russian Classification of Types of Economic Activity) of the organisation must be specified. For its part, Rosturizm asks that the information relating to entry should be drawn up in table format.
In addition, the information on the official websites differ in the list of documents to be attached to the application: Rosturizm recommends submitting a passport, visa and a valid employment contract (or civil law contract), while the Ministry of Justice of Russia in addition to this recommends a work permit for the CCS, as well as documents confirming the relationship of incoming family members if necessary.
Please note that the requirement to present an employment or civil law contract has been removed by Russian Government Decree No 3675-p of 30.12.2020, but as it appears from the communications cited, it is still among the recommended documents.
