№ | QUESTION | ANSWER |
1 | The procedure for extending the period of stay of foreign citizens in the Russian Federation whose specified period expires after 15.06.2020 is not defined. So the question is the possibility of making a decision to extend the period of stay of a foreign citizen in the Russian Federation on his reasoned application for the impossibility of leaving the Russian Federation in accordance with the requirements of the instruction of the Ministry of Internal Affairs of Russia dated 19.03.2020 No. 1/2964. | Decree of the President of the Russian Federation No. 392 of 15.06.2020 amended Decree of the President of the Russian Federation No. 274 of 18.04.2020 (hereinafter-Decree No. 392, Decree No. 274), which extended the temporary measures to regulate the legal status of foreign citizens until September 15, 2020. During the specified period, i.e. from March 15 to September 15, 2020 inclusive, foreign citizens and the host party are not required to perform actions to extend the terms of temporary stay (including visa extension), the terms of migration registration, the terms of temporary and permanent residence (including the extension of a residence permit). 2 | Explain the procedure for extending the stay of foreign citizens who arrived on a visa basis, whose visas expire after June 16, 2020 and there are no grounds for extending such visas, in accordance with Federal law 115-FZ, but foreign citizens cannot leave the territory of the Russian Federation due to the closure of the border? If a citizen was unable to leave within the time limit set by the visa, does his legal status fall under the Decree (will there be a regulatory document), or does he need to get a transit visa when leaving? | In accordance with Decree No. 274, visas of foreign citizens that expired between March 15 and September 15, 2020, are valid from the expiration date specified in the visa for 185 days, including for leaving the Russian Federation without the need for a transit visa. Example: if the visa expired on April 1, 2020, it will be valid for departure from the Russian Federation for another 185 days (until October 1, 2020). Due to technical features, if the e-visa expires within the specified period, for when leaving the Russian Federation, you must apply for a transit visa (the state fee for issuing a transit visa is charged). Under these circumstances, foreign citizens are not subject to administrative liability. |
