According to this law, in the event that a Russian court imposes a sentence on a foreign citizen that does not involve imprisonment, as well as the application of a suspended sentence or a deferment of serving (execution) of the sentence, this citizen shall be expelled to the state of the citizenship of the convicted person.
If, on the basis of a court decision based on the results of consideration of a submission from a federal executive body authorized in the field of execution of punishments, or an appeal from a convicted person or his representative, or an appeal from a competent authority of a foreign state in accordance with an international treaty of Russia or a written agreement of the competent authorities of Russia with competent authorities of a foreign state based on the principle of reciprocity.
If the specified punishment is imposed in the form of a fine, the execution of the punishment is not subject to expulsion to the state of citizenship of the convicted person.
The adoption of this law is associated with the ratification of the Convention of the CIS countries on the transfer of execution of non-custodial sentences.
The law came into force on the day of its publication, that is, April 22, 2024, and extends its effect also to foreign citizens in respect of whom the court decision has not entered into force due to a delay.
Also, on April 8, 2024, the initiative group of the LDPR faction submitted for consideration to the State Duma of Russia a draft law providing for a lifelong ban on entry into Russia of foreign citizens who have committed a crime, regardless of the category of crimes, as well as the cancellation of temporary residence permits and residence permits of foreign citizens and members of their families who have committed crimes and administrative offenses.
